Remark from an advocate friend when I asked him on ADSL:

If you want a legally enforceable guarantee from Telkom, buy a fridge and cool down :-)

Telkom has so much mmoney, they can hire teams of the best lawyers and the highest rates for months without reducing earnings per share with a cent.

Apparently some big corporations have the habit of twisting legal costs to the extend that the aggrieved must give up because he has no money left. Then they sue him for costs and have him liquidated for the having the cheek of taking them to court in the first instance.

The courts allows this - and that is why big corporations can do what they like. They know that even if 1000's of consumers team up against them, they still have enough money to through at legal teams to destroy those taking them to court eventually.

Yip - that's why I have said in previous posts - it's useless taking legal action against Telkom - BUT I do think taking the govt to consitutional court over infringement of consitutional rights may have merit.

And what about the possibilities of a "class action" type law suit. Perhaps someone with legal knowhow can comment?

Yip - that's why I have said in previous posts - it's useless taking legal action against Telkom - BUT I do think taking the govt to consitutional court over infringement of consitutional rights may have merit.

Telkom has also used this tactic against ICASA. In the past ICASA has had to appeal to parliament for the money to take Telkom to court. [The regulator's independence is severely compromised by the fact that they are reliant on parliament (& MoC) for funding.]

If this is the case, then they need to change the law. Justice should not side only with those with deep pockets. I'll bet it would also be unconstitutional.

ek sien jy lees al weer soos die laaster 3 letters in my naampie ...

ek hou nie van telkom nie en soos ek voorheen gewys het :p = tonguitsteek ... want ekke betaal nie vir telkom 'n sent nie

There is a third option. Leave the country and let it die. Then Telkom + Government can reap what they sow.

This tactic is called tough love and is done for some people that have problems but will not acknowledge them. They hit rock bottom and either commit suicide or pull their lives back together.

I believe that is what Africa needs. We need to pull out all aid, all assistance and most importantly, all free rides. Then Africa can decide if it lives or dies. After that, either way, problem solved.
