The situation:

Incredible connection is hosting a demo sale on their website.
This sale includes and xbox gaming console for R999.
This has been the price since i first saw it on Saturday R999.

This morning, 21/06/2011, the price had changed to R153.80 next to it stating SAVE R846.15 in bold and in red.
This is one of the only 2 products on the page stating the saving amount.

After completing the on-line purchase process including an electronic invoice emailed to my inbox i got a subsequent phone call from incredible connection
saying that the price is R999 and offering an ultimatum, either pay R999 or we cancel the order.

They also pointed me to there poor disclaimer on their website, telling me they have the right to do this.
Their discalimer :"As erroneous or outdated prices could be displayed from time to time, you agree that we cannot be obliged to sell a product at such erroneous price. "

Is the price you see not the price you pay?

Can anyone assist with this?? Do I have a leg to stand on?

From my CPA training document:


inadvertent and obvious errors in a displayed price are not binding if the supplier corrects it and takes reasonable steps to inform the customer of this error

Unfortunately you do not have a leg to stand on, as even if the disclaimer is poor, it still indicates exactly what you've described, erroneous or outdated prices, they have to protect themselves. You cannot even get this in shops anymore unless you really whinge.

have they corrected the pricing on the website?

If yes it shows it was an error
If not it shows they are truly incredible corruption

Personally I feel that since they agreed to the transaction and went so far as to invoice you they should have honoured it. Probably doesn't mesh with the new CPA though.

Can't blame anyone for wanting to get one over Incredible Connection, but they're well within their rights to renege on a transaction made in error.

This is what it's for (http://www.acts.co.za/consumer_protection_act_2008/index.htm):

To promote a fair, accessible and sustainable marketplace for consumer products and services and for that purpose to establish national norms and standards relating to consumer protection, to provide for improved standards of consumer information, to prohibit certain unfair marketing and business practices, to promote responsible consumer behaviour, to promote a consistent legislative and enforcement framework relating to consumer transactions and agreements, to establish the National Consumer Commission

It's not meant as a consumers' step-by-step to ripping off retailers.

Its been completely removed from the site

So it could be a RROD box for all you know.
They can't sell you a broken product, because that will be covered by the CPA. If it was a RROD unit, it would most likely have been sent in to Powercare for a replacement unit.

Yes normally if there's an obvious error they don't have to give it to you at that price. But I don't know wtf is up with that SAVE part, that seems a bit like a good old-fashioned bait-and-switch. If it's an obvious error why would they make such a point of telling you you get R846.15 off?

Still If you could get an XBAWX for R153.80 I'd even get one. I'd find something to do with it, somehow.

They probably "agreed" to the transaction as its an automatic system. When it came through to an actual person, thats when the error was picked up and you were notified.

The "system price" was probably set to R999 for Demo XBOX units. When the price was incorrectly/iinadvertentlt changed to R100-odd, the saving was automatically calculated.

There's a bundle with Gears of war, for R999. Just be aware that its not exactly new but demo models. So returned or display units

True... and it's the older spec. I want the new slimmer Xbox when I buy. I'll wait it out a little, PC gaming will have to do for now.
