PetroSA has suspended a top executive implicated in the R1-billion scandal that is rocking the parastatal.

Everton September, a vice-president in charge of the company’s new oil and gas ventures, was suspended on Tuesday, the Mail & Guardian has confirmed.

September faces questions over his role in PetroSA’s 2012 acquisition of a company with oil acreage offshore of Ghana, where he and former acting chief executive Yekani Tenza allegedly negotiated the price “in reverse” – costing South Africans R162-million extra.

Last month, the M&G exposed questions around this and PetroSA’s ongoing effort to buy out oil company Engen. Allegedly the company overpaid or needlessly risked about R1-billion on the deals.

PetroSA’s chairperson Benny Mokaba resigned on the back of the exposé, after apparently being told to go. And the company then cancelled its R187-million contract with a consultant firm that had been implicated.

The M&G also revealed evidence that kickbacks might have been paid in the Ghana deal.

The Hawks police unit is investigating PetroSA, and a probe by the Central Energy Fund, its holding company, is said to be complete.

Represented value for money

The parastatal and Tenza have defended the extra R162-million he and September agreed to pay for the Ghana acquisition, saying it still represented value for money.

The oil company has admitted to “some deviations from our normal procurement processes”.

On Thursday, PetroSA confirmed September’s suspension: “At its meeting on Tuesday, the PetroSA board resolved to suspend September as a precautionary measure. This is to allow an investigation to take place into various allegations. The suspension is intended to enable the investigation to take place without any possible perception of undue interference.”

September could not be reached for comment.

A case before the Mississippi Supreme Court could lead to jail time for unintentional pregnancy loss.

Mississippi’s state Supreme Court is currently considering a case that could lead to women being prosecuted for manslaughter if they miscarry or otherwise experience unintentional pregnancy loss, according to a report from Kate Sheppard at Mother Jones.

In 2009, two months after Nina Buckhalter’s pregnancy ended in stillbirth, a Mississippi grand jury indicted her for manslaughter, citing her use of methamphetamine while pregnant as “culpable negligence.” Buckhalter’s attorneys challenged the charge; the Supreme Court hearing began in April and a ruling is expected soon.

Buckhalter’s lawyers, as well as reproductive health advocates in Mississippi and across the country, contend that the charges, in addition to criminalizing countless women, could deter women struggling with drug and alcohol addiction during pregnancy from seeking prenatal care or treatment for substance abuse for fear of being prosecuted and create barriers to safe abortion care.

Sheppard goes on to report:

Quote:

If prosecutors prevail in this case, the state would be setting a “dangerous precedent” that “unintentional pregnancy loss can be treated as a form of homicide,” says Farah Diaz-Tello, a staff attorney with National Advocates for Pregnant Women, a nonprofit legal organization that has joined with Robert McDuff, a Mississippi civil rights lawyer, to defend Buckhalter. If Buckhalter’s case goes forward, NAPW fears it could spur a wave of similar prosecutions in Mississippi and other states.

Mississippi’s manslaughter laws were not intended to apply in cases of stillbirths and miscarriages. Four times between 1998 through 2002, Mississippi lawmakers rejected proposals that would have set specific penalties for damaging a fetus by using illegal drugs during pregnancy. But Mississippi prosecutors say that two other state laws allow them to charge Buckhalter. One defines of manslaughter as the “killing of a human being, by the act, procurement, or culpable negligence of another”; another includes ”an unborn child at every stage of gestation from conception until live birth” in the state’s definition of human beings.

The cause of any given miscarriage or stillbirth is difficult to determine, and many experts believe there is no conclusive evidence that exposure to drugs in utero can cause a miscarriage or stillbirth. Because of this, prosecuting Buckhalter opens the door to investigating and prosecuting women for any number of other potential causes of a miscarriage or stillbirth, her lawyers argued in a filing to the state Supreme Court—”smoking, drinking alcohol, using drugs, exercising against doctor’s orders, or failing to follow advice regarding conditions such as obesity or hypertension.” Supreme Court Justice Leslie D. King also raised this question in the oral arguments last month: “Doctors say women should avoid herbal tea, things like unpasteurized cheese, lunch meats. Exactly what are the boundaries?”

And while the court has yet to rule in Buckhalter’s case, the circumstances are troublingly familiar: There are already 38 states with “fetal homicide” laws that, as RH Reality Check notes, have been used in 400 cases to criminalize, rather than protect, women after they experience unintentional pregnancy loss.

Link.

Bit of a sensationalist headline, but it's a difficult one. Should they prosecute women for knowingly endangering the health of their unborn babies?

Gun Free South Africa calls for an immediate moratorium on the issuing of firearm licences for all categories of users: dealers, training institutes, civilians and the private security industry.

Since 2010 it has been public knowledge that the Central Firearms Registry (CFR) is not functioning as it should. Instead of improving its function as was promised by the Minister of Police, it has got worse:

* On 3 March 2012 The Weekend Argus reported that Brett Kebble's killers, Mikey Schultz and Nigel Mcgurk were reissued a total nine firearm licences between them. These men were known to have a history of violent behaviour yet they ‘slipped' through the system;

* The alleged corruption of firearms dealers and officials in the CFR reported just last week leading to the Minister of Police establishing a commission of inquiry to investigate unscrupulous dealers in firearms and illegally-operating firearms training institutions.

And now this scandal - the buying of a training certificate from an accredited firearms training centre for a mere R1000!

The Firearms Control Act meets international norms and standards in the regulation of firearms. It is a good law, but only as long as it is implemented properly.

Recent events confirm Gun Free South Africa's concern over the last two years: The law is not able to do what is should be doing because key role-players in the chain to ensuring that only ‘fit and proper persons' are issued with a gun licence are circumventing the law. It is outrageous that those who purport to support and uphold the idea of ‘responsible gun ownership' will sell a training certificate for R1000.

The main purpose of the Firearms Control Act is to regulate who owns what gun for which purpose. This latest expose underscores that this is not happening.

We are all unsafe. Calling for a complete moratorium is both reasonable and practical, which we believe all South African's will support

Gun Free South Africa is working towards a safer, more secure South Africa, by reducing gun violence.

South Africans have many questions regarding terrorism, it's support and it's financing in SA. Some on this forum and elsewhere, go to great lengths to discourage others from mentioning/discussing it, whilst also refusing to answer those points that prove the existence of a certain amount of terrorist activity on SA soil.

Some of the info to follow, will be from Prof. Solomon, whom some forum posters have said, has little respect from Muslims in general. This is interesting, since he is Muslim and has the same view, as most Muslims who post here, in that he also feels that terrorism is not part of his religion.

Please read all of the info from the various links posted, in order to keep the discussion as informed and helpful, to those who wish to understand radicalization and terrorism better. This first link is from a site that criticizes Solomon. Him being a Muslim, with the same opinion regarding terrorism as most Muslims, shows that he is genuinely concerned as a Muslim. Those that take issue with him, therefore do so for specific reasons, usually feeling he is trying to hurt Muslims.

Quote:

“For more then a decade, Hussein Solomon has been desperate in getting government and security agencies to gang up against legitimate Muslim activities in the country.”

...

Speaking to Cii News this morning, Solomon who referred to himself as a practicing Muslim, said he seconded the reports of an Al Qaeda mobilisation within South Africa.

“I think it is imperative that Muslims stand up and say: ‘These people do not speak in our name. This is not my religion, I will not attack the innocent, neither will I allow any member of my faith to attack the innocent on the basis of a complete misinterpretation of the Quraan.”

http://www.ciibroadcasting.com/2013/...africa-expose/

Since we can safely say that Solomon is merely another deeply concerned Muslim, what started his quest? Again, please read the entire article from each quote/link provided.
The bombing of Planet Hollywood also resulted in my quest to understand the phenomenon of terrorism in South Africa.

Unfortunately, my study of terrorism in this country has raised more questions than answers on account of the ambiguous nature of government responses. Frankly, one is unsure whether the ambivalent and contradictory responses from the post-94 Pretoria government emanate as a result of incompetence or of political correctness or a combination of the two.

http://muslimsinafrica.wordpress.com...ssein-solomon/

Coming to Grips with Islamist Radicalization in South Africa

When discussing issues of radicalization in Africa, commentators often examine the case of Somalia’s Al Shabaab or Al Qaeda’s North African franchise – Al Qaeda in the Arab Maghreb. Very little attention is paid to radicalization amongst South Africa’s Muslim population which comprises a paltry two percent of the total population.

Is radical Islamism spreading in South Africa? The answer has to be an emphatic yes.

One could, of course, look at various publications and websites spewing forth this Islamist rage but one of the most interesting is an interview which Khadija Abdul Qaheeer conducted with Mustafa Jonker, one of the men arrested in a Muizenberg, Cape Town police raid for allegedly attempting to start a terror campaign in South Africa.

Whilst excerpts from the interview are long, it provides fascinating insights into the Islamist mindset:

http://muslimsinafrica.wordpress.com...ssein-solomon/

This next article was posted in PD forum, where no Muslims bothered to discuss it's contents. I sincerely invite Muslims to get involved in the discussion and like Solomon, show that you do care, that radicalization is a concern for everyone, Muslim and non Muslim.

Quote:

While South Africa has a small Muslim population, comprising just 1-2 percent of its population, Islamism has a distinct presence in the country. The country is generally considered peripheral to the global war on terror given its distance from the traditional hotbeds of Islamism, but in recent years both transnational and domestic Islamist groups have been active on South African soil.

Given the nation’s history of political violence, it faces a continued risk of Islamist-inspired violence. There were Islamist attacks in South Africa in the late 1990s and threats of attacks in recent years. Additionally, the country continues to confront significant obstacles that could raise its threat level, including considerable economic and social cleavages left over from the apartheid era, increasing crime rates, and high unemployment rates.1

If not successfully tackled, these factors could contribute to a rise in radicalism and violence. South Africa’s liberal democratic government allows religious groups to be active in the country’s politics. As a result, Islamist inspired political parties and organizations that advocate for Sharia are present in South African society today. While these groups do not enjoy mass support, their presence indicates the potential for Islamist terrorism in South Africa.

http://almanac.afpc.org/South-Africa

Obviously, some here will point to his being a Muslim, makes him in some way, too soft in his evaluation, of the situation. At least, IMO, as a concerned Muslim, he is trying to do as much research as is possible, considering the lack of info emanating from the security structures of SA.

Many Muslims were quick to claim that the article that mentioned the Dockrats, was just the imagination of those that dealt with them. Farhad Dockrat states in his response, (point 10 and 11) that the financing of a particular group, was done before the group was designated a terrorist sponsoring organisation and, that our government found no terrorist activity connected to them, yet neglects to mention/discuss anywhere, in his response, the USA info, which claims that there WAS actual phone and email contact, with terrorist groups.

This info below, coupled with the other info above, regarding their various actions, should at least concern Muslims...the moderates, that is.

Quote:

Junaid Dockrat in 2004 worked via phone and email with Al Qaida operations chief Hamza Rabi'a (now deceased) to coordinate the travel of South Africans to Pakistan in order for them to train with al Qaida.

I feel sorry for our, or any African Nation's troops, should they need to go up against terrorists, who are dressed in these camo's... http://www.sniperafrica.com/storieslink.html

One needs to ask, in the absence of input from our nation's government, is it possible that this info (phone and email records)was in fact provided to our government, who then decided to rather let investigations run longer, instead of taking immediate action with info, that may have stood less chance of a long term conviction, regarding terrorism?

This cryptome link's info on hamas in SA, also creates doubt, regarding our government's willingness to confront the issue, of Islamic radicalization and terrorist activity on our soil.

Please be civil with each other and debate the issue, without resorting to personal insults, in order to keep this thread from being locked, as has been done to other threads discussing Islamic Radicalization/Terrorism in South Africa.

BERLIN — German authorities arrested Monday a 93-year-old alleged former guard at the Nazi death camp Auschwitz on charges of complicity in the mass murder of prisoners.

Prosecutors in the southwestern state of Baden-Wuerttemberg said the man was believed to have worked at the camp between autumn 1941 and its closure in 1945.

Authorities declined to release the suspect's name but media reports and the Simon Wiesenthal Center said it was Hans Lipschis, who figures among the Center's most-wanted Nazis and is said to have served in the SS "Death's Head" battalion.

The man, who was detained at his home, "appeared before a judge and was taken into custody", the prosecutor's office in the state capital Stuttgart said in a statement.

"The indictment against him is currently being prepared."

Stuttgart prosecutors confirmed to AFP last month that they were working on a probe launched late last year against a suspect who had worked at Auschwitz.

Lipschis has been living in the Baden-Wuerttemberg town of Aalen and reportedly told the authorities that he worked as a cook, not a guard, in the camp in then occupied Poland.

However prosecutors said the evidence pointed to the fact that the suspect in question had broader responsibilities.

"He took on supervisory duties although he did not only work as a guard," a spokeswoman for the prosecutor's office told AFP.

"We will try to determine concretely when and what he did at Auschwitz."

She said the suspect was not believed to have killed prisoners himself but rather "that he abetted the actions of the perpetrators".

Despite his advanced age, the suspect underwent a medical examination and was determined fit to be taken into custody.

The Simon Wiesenthal Center, in its 2013 report, lists Lipschis as its fourth most-wanted Nazi, saying he served in the SS-Totenkopf Sturmbann (Death's Head Battalion) from 1941 until 1945 at Auschwitz, and "participated in the mass murder and persecution of innocent civilians, primarily Jews".

Lithuanian-born Lipschis was granted "ethnic German" status by the Nazis. He moved to the United States in 1956 but was deported to Germanyin 1983 for failing to reveal his SS past, Welt am Sonntag newspaper reported last month.

More than one million people, mostly European Jews, perished at Auschwitz-Birkenau, operated by Nazi Germany in occupied Poland from 1940 until it was liberated by the Soviet Red Army on January 27, 1945.

Germany has broadened the scope of its pursuit of Nazi war criminals since the 2011 conviction of Ukraine-born John Demjanjuk, a former guard at the Sobibor death camp in Poland.

In that case, the court ruled that any role at a death camp amounted to accessory to murder, widening culpability from those found to have personally ordered or committed murders and atrocities.

Demjanjuk was sentenced to five years' prison for complicity in some 28,000 murders. He died at a nursing home last year while freed awaiting an appeal.

Lipschis is among 50 surviving Auschwitz staff who are being investigated in Germany under the broadened culpability rules.

The Simon Wiesenthal Center hailed the move.

"The arrest of Lipschis is a welcome first step in what we hope will be a large number of successful legal measures taken by the German judicial authorities against death camp personnel and those who served in the Einsatzgruppen (mobile killing units), which together murdered more than three million Jews during the Holocaust," the director of the Center's Israel office, Efraim Zuroff, said in a statement.

However renowned French Nazi hunter Serge Klarsfeld said he had mixed feelings about the news from Germany.
"I am torn between my idea of justice and the necessity to chase down war criminals until they take their last breath," he told AFP.

"You need evidence and documents to incriminate them and I think there won't be any more eyewitnesses to implicate them."

Did a hacker just pwn a hatemonger?

On Tuesday, Fred Phelps Jr., the son of Westboro Baptist Church minister Fred Phelps, linked the devastation from the F-5 tornado that hit Moore, Okla., to the Oklahoma Thunder's support for openly gay NBA basketball star Jason Collins. Within hours, someone purchased the domain name GodHatesOklahoma.com through GoDaddy.com.

Later that day, a self-proclaimed "hacktivist" using the Twitter account @th3j35t3r either hijacked the page or purchased it himself and pretended to have accessed it.

Either way, the site now features a picture of Jesus Christ flipping off the Westboro Baptist Church and noting "Even Jesus Hates You." Five seconds later, the page redirects to another page that claims "This site has been seized and put to good use by @th3j35t3r - Stay Frosty."

The content of the second page appears to feature information on how to donate money to the American Red Cross Disaster Relief fund.

While @th3j35t3r may have had good intentions at heart, people wishing to support the victims of the tornado are strongly advised to do so on the humanitarian organization's official website.

Source: http://www.huffingtonpost.com/2013/0...n_3324292.html

Hackers gonna hack, and this time the deserving target is the Westboro Baptist Church.

The notorious Christian fundamentalist group, never one to sit out a good chance to offend everyone on earth, decided that "God hates Oklahoma," and in the wake of the massive EF5 tornado that killed 24 people in the city of Moore, Okla., on Monday, the Westboro folks set up a website called just that.

The site's contents -- surely nothing more than a string of hateful remarks and hurtful insinuations -- are no longer visible to visitors. They've been replaced by just two pages that flip the script on Westboro (we refuse to link to their offensively named homepage), which likes to allege that just about everything tragic that happens in America comes as a result of an evolving list of alleged "sins."

When web users first arrive on the site, they are greeted by a painting of Jesus Christ giving the middle finger, accompanied by the message "Westboro Faptist Church -- Even Jesus Hates You" ("Faptist" combines the word "Baptist" with the term "fap," online slang for masturbate).

Below that image is another message that reads, "'On the 8th day, God created hackers, and he saw that it was good.' From the Gospel according to @th3j35t3r Redirecting in 5 seconds......."

Moments after visiting the site, web surfers are directed to the donation page of American Red Cross Disaster Relief, where they can make a contribution to help Oklahomans recover from the disaster.

The hacker, who also refers to himself as Jester, aims to redirect the hate of the Westboro folks and perhaps turn it toward good. And it's hilarious.
We call on the ANC councillors to focus on cleaning that municipality of the opposition rot. Their first task is to nullify all the irregular appointments starting with the Municipal Manager who has no qualifications to the lowest level that was irregularly employed. We call on our affiliate SAMWU to work together with the council to identify all those irregular appointments that have plunged that municipality into the brink of bankruptcy.

The opposition gang must also be made to pay for illegally withholding the salaries and benefits of the ANC councillors in the run-up to this crucial election. The R106.00 that is illegally charged to the poor people for the electricity poles must be scrapped with immediate effect.

The experiences of the people of Nama Khoi against the DA led coalition are a taste of the bad governance and high levels of exploitation that they desperately want to introduce in our country. It therefore stands to reason that our people should refuse to be misled into believing that the DA cares for our people as they desperately claim. The high levels of discrimination that took place in that municipality exposé the DA for what they really are, the architects of apartheid that they claim to have fought against.

A man was sentenced to 11 years imprisonment by the Nelspruit Regional Court on Thursday for trespassing and carrying out a restricted activity in the Kruger National Park.

Abel Mfana Mashabane, 26, from Phalaborwa, pleaded guilty to charges of trespassing in a designated area, after he and his friends were caught walking through the park at Houtboschrand on May 17, 2012.

Mashabane was shot and wounded when he and his friends were detained by game rangers.

"Other rangers began assaulting me, accusing me of owning the rhino horn which I suspect was brought by them and was planted in my bag,” he told the court.

Mashabane had previously testified that rangers framed him. The court heard the rangers had seen the men trying to cross into Mozambique with a bag containing a rhino horn with a street value of R250,000.

During sentencing, Mashabane's lawyers said prison was not a place for his client as his hip was dislocated when he was detained.

“Prison will be worse for him as he has been on crutches since the day of arrest. He has acknowledged the seriousness of the offence he faces, and that rhinos get killed on daily basis,” his lawyer said.

State prosecutor Isbet Erwee said the court should not set Mashabane free because of his injuries as he would be cared for in prison.

"Luckily he lost his hip and not his life," she argued.

Magistrate Shila Msibi did not find Mashabane guilty of possession of a white rhino horn because neither the carcass nor killing site could be located. Msibi said she would not take an armchair approach as rhino killings were on the increase.

“It seems this year's rhino killings will exceed last year's statistic as currently, it stands to 238."

She sentenced Mashabane to eight years for carrying out a restricted activity in a designated area, and three years for trespassing. The sentences will be served consecutively.

Mashabane's lawyer indicated his client would appeal the sentence on June 4.

Reports of collusion between police and criminals in the Western Cape are a serious allegation, the police ministry said on Thursday.

"Should they be proven true, they could compromise and derail efforts of crime reduction, not only in the Western Cape but the whole country," spokesman Zweli Mnisi said in a statement.

The department was responding to a report that gangsters on the Cape Flats were shielded by an army of foot soldiers, as they used their wealth to buy information from authorities.

Hanif Loonat, chairman of the Western Cape Community Policing Forum, reportedly said gangsters' intelligence gathering was up to 10 times better than the police's.

"There are police officers who give them information, [who] tell them what the police's plan are...They have people at ministerial level, in Parliament, in local government. These guys pay for information," Loonat was quoted as saying.

Criminologist Eldred de Klerk reportedly agreed with Loonat, saying there were "corrupt agents" within the police.

"The police should be subjected to polygraph tests," De Klerk said.

The ministry called these allegations "worrying" and "image-tarnishing".

"I view these remarks in [a] serious [light] and challenge both Loonat and De Klerk to come forward with evidence to back up their claims," Mnisi said.

"Indeed if the claims are true, the law would have to take its course irrespective of whoever is involved."

Mnisi cautioned against generalisations when making allegations.

"Police are not immune to criticism as much as civilians are not. However we want to caution against grandstanding," he said.

"If there are any allegations of collusion between police and criminals, government has various oversight structures such as the Independent Police Investigative Directorate, the Civilian Secretariat for Police [and] the presidential hotline which they can utilise to report such matters."

Two women stole the show in the National Assembly on Wednesday for their bravery during the March battle between SA soldiers and Central African Republic (CAR) rebels.

Opening debate on her Budget Vote, Defence Minister Nosiviwe Mapisa-Nqakula made Susette Gates and one Corporal Nkoana stand up in the house.

She described how they put their lives at risk during the CAR clash, which left 13 SA National Defence Force members dead.

Gates was not soldier, but a civilian who works in the department's finance management division.

She was the financial officer for the SANDF mission in the CAR.

"When she (Gates) and the other contingent of civilians became aware of the imminent attack by the rebels they vacated their accommodation and were relocated to a safer place," said Mapisa-Nqakula.

Gates was forced to leave behind a significant cash contingency.

"She knew that should the money be discovered it would fall in the wrong hands and be used to fund rebel activity.

"At the height of the battle, she returned to the base to fetch the money and accounting documents, at great risk to her life," the minister said.

While leaving the base, Seleka rebels accosted her -- demanding she hand over the money, which she had hidden in bags.

"She managed to convince them that she was carrying clothes and hitch hiked with French troops to the airport," Mapisa-Nqakula told MPs.

Gates returned to South Africa with the money, totalling R3m in foreign currency.

Corporal Nkoana is an army medic who volunteered to assist her wounded colleagues during "the heat of the battle".

"Whilst returning to the base the convoy was ambushed by Seleka rebels.

"Without vehicles and maps to guide them to base, 16 members were cut off from their company and realised that their hiding place was surrounded by rebels," the minister said.

This is where Nkoana earned the nickname "the human navigator", leading her colleagues out of rebel territory.

"For two long days and nights, they moved under her command and guidance, carrying casualties of war... Her actions saved all 16 of our soldiers, including two who were shot."

Mapisa-Nqakula described the two as "heroines" and "true patriots".

Government's waste tyre recycling plan is back on track after a Supreme Court of Appeal ruling on Thursday.

The court found in favour of the environment and water affairs minister in a matter against the Retail Motor Industry (RMI).

The RMI brought a case against the minister and the Recycling and Economic Development Initiative of SA (Redisa) to block implementation of the Redisa Integrated Industry Waste Tyre Management Plan.

"We are delighted by the outcome of this judgment, which has thoroughly tested the principles of the Redisa plan and found them to be sound," Redisa CEO Hermann Erdmann said.

The court dismissed the key grounds of RMI's complaint with the proviso that solid tyres be excluded from the plan.

"This is a minor amendment to the plan, with solid tyres constituting two percent of total annual tyre production," said Erdmann.

The SCA found that the references to solid tyres were severable.

"It is possible, textually, to separate the references to solid tyres from references to tyres as defined in the waste tyre regulations," the court found.

"The references to tyres as defined are not dependant in any manner on the references to solid tyres, because solid tyres are always referred to expressly and separately from tyres as defined."

The unanimous judgment by a full bench held that the RMI's appeal should be dismissed.

Erdmann said Redisa could now begin implementing the plan's original intention, which was to remove waste tyres from the environment while creating jobs and building a recycling industry.

Erdmann said the plan's implementation, which had been delayed due to court proceedings for over 12 months, would be ramped up to deliver results.

"We are ready and prepared to move ahead with the next stages of the plan, namely to establish the collection and recycling networks," he said.
