    ...because mybb and a couple of their "industry leader" telecom mates tried to force them into disclosing the details of their spectrum agreements by claiming they were not legal.
    Screamer refused to be drawn into this irresponsible reporting but there are still a few "industry leaders" who would like to see this rumour propogated for obvious reasons, despite the fact that Screamer is still operating and despite all of the mybb reporters fuss nothing has been reported to ICASA.... and rumours are surfacing that there are in fact agreements in place.

    Well if they are still going, i would assume that they are fully legal.

    I have read the legislation , and I couldn't come to any conclusions. Its a bit ambiguous , but it looks very much like the ONLY person (juristic in this case) that may install and operate infrastructure that uses a certain spectrum is the person who holds the spectrum license. We know for sure that screamer does not hold a spectrum license because its the 2.5/6Ghz wimax spectrum and those licenses have not been issued yet. Moreover , they were not granted one from the last round of applications.

    There seems to be no provision for reselling or leasing out the license , and no provision for granting sub permission (Which happened in this case when Sentech granted them permission , as I understand). I think screamers management are taking advantage of this ambiguity by saying "If it isn't specifically disallowed then it is allowed". I personally think this is a mistake on their part , but im not a lawyer and could be wrong. Maybe dominic can hop in and provide an interpretation.

    I think if screamer was challenged in court on this issue it would be interesting. My guess is they are still running because they havent been challenged , or the issue has not been reviewed by ICASA.

    I wouldn't mind trusting Screamer. Nobody can be operating under more shady grounds than Telkom..
