What it boils down to with a simple analogy : Buying a DVD writer is not illegal but copying movies onto DVD's from torrents are illegal. The same applies for IOS. Jailbreaking a phone is legal, what you do with the jailbreak may not be legal e.g. installing apps that have been cracked.
