They don't have to. But if they choose to, they're well within their right to do so. That is my argument.
Regarding trademark law (to the best of my knowledge) confusion is not the only criteria and one can certainly argue the merits of any of the previous points I have raised. As I have said far too many times in this thread already, I have no issue with the confusion bit. I've never stated a reasonable consumer would be confused...

I saw Walkden's first and the logo looked a lot like what I remembered Waltons' logo to be, but when I actually looked at Waltons' logo they are different
