    Default 3rd Party Divorce Question

    Hey all,I've had to register under a different username to post this. I cheated on my wife and she wants to take the other lady to court which is not the point of the my question. I want to move out my house and live with the other lady. So far, my wife has received a summons informing her of a divorce. If I had to move out while I am not divorced and live with this other lady, would it help my wifes 3rd party claim against this other lady, or won't it make a difference as the cheating already happened?

    It will definitely give her case merit. That is why lawyers always suggest to wait until the divorce is finalized, however, since she was the cause of the break-up, your wife still has a case. Living with your girlfriend would just make matters a lot worse for her.

    Having said that. If I ever meet you in real life, expect a swift ass-whooping that will land you in hospital or worse. I don't know what angers me most, the fact you had someone that loved you enough to marry you, or the fact that you threw it all away and spat in her face by cheating on her, your wife, someone that was prepared to spend their life with you.

    People like you disgust me. My only wish is to find someone that loves me as much as I do them and be with them. Yet guys like you go gallivanting with no remorse to your actions.

    Divorce in this country is the no fault principal . either you want a divorce or you dont, so if you slept with 1000 women means nothing as far as the divorce is concerned .That said you wife is entitled to sue the other party for breaking up your marriage .

    Thanks for the reply, but she was not the cause for the break up. My wife and I were on a trial separation due to other matters before the other girl was involved and the cheating happened when the trial separation had started.

    oops sorry, disregard previous post. I dont think there would be grounds for a lawsuit if the cheating happened AFTER separation.
    Is that even still classified as cheating?

    I only read this now. Then she has no leg to stand on. Your lover is not the cause of breakdown.

    You moving out though will worsen your case when splitting up assets so you should be more worried about that. Since she has no case against your lover this could be a trick by her lawyer to strengthen her case when splitting up the estate.

    She is entitled to sue you, whether she goes through with it is another thing, clearly your wife is a heart-broken woman right now and if i were you, wouldnt fluck with her. AND sies on you for evening thinking about moving in with the other woman after doing this to your wife.

    Just remember, the grass always isnt greener and you will probably end up alone after all is said and done!

    This depends.

    Before you met lady X was your marriage on the rocks, having problems or were there not any problems?
    If there wasn't any or let say you can't prove there was (you never discussed being unhappy or she didn't have a clue) then the case has merit as it means your lover is the root cause for the breakdown in marriage and not a general breakdown.

    Then yes I think you living with the girl will strengthen her case as it means the marriage has totally broken down i.e. no chance for reconciliation.
    You showing a blatant disregard for the sanctity of marriage by going to live with your lover without the divorce being finalized is going to make you look like an arse and will be presented in court to bolster both your wife's case when splitting up the estate and the case against your lover.

    What sorta marriage contract is in place ?

    COP or ANC ?


    That ought to sort out the legal matters...

    This isn't USA... Not so sure that you can be sued for divorce... Perhaps for emotional destress and if there were other financial implications should the divorce be effective ...

    Alienation of affection is actionable in SA.

    If the wife made the husband miserable... Abused him emotionally... Slept in a different bed or maybe a drunk then OP perhaps had reason to seek solace elsewhere.

    We already sorted out the divorce stuff and who gets what etc. The new thing is that the divorce is now getting blamed on lady X even though something happened after the trial separation. My wifes family knew that we were talking about divorce last year but now there is a scape goat. Anyway, thanks for the replies.

    With "something" I hope you mean flirt and not f'ed. Even if you didn't do the deed before if wifey can prove something (dates or flirting) started before then ...

    No we didn't f at all, still haven't. Things only happened after the trial separation started
