Thread: Sick Leave in first year with company

    During the first 6 months of employment, the employee is entitled to 1 day sick leave for every 26 days worked. On the first working day of month number 7, the balance of the 30 days becomes available to the employee, less any days taken sick during the first 6 months of employment.

    That is what the labor law states...

    It's the number of regular work days in a 6 week period. So if you're in an industry that has 6-day working weeks, you get 36 days sick leave per cycle, and if you're in an industry with a 5-day work week you get 30 days.

    Most corporates default you to the full entitlement on your first day of employment. They could, however, go strictly by the BCEA and give you one day for every 26 days work in your first 6 months. Remember, most employers aren't there to screw you over and if you have a legitimate reason to take sick leave, even within your first 6 months you may find them understanding and come to some sort of agreement.

    Also you usually have to undergo a medical prior to employment, was that the case here?

    No, it was not required.

    Talking about US corporates IBM, Unisys etc. They're normally pretty good in situations like the OP is discussing.
