If I'm not mistaken (get a lawyer to clarify this), they're in breach of their own contract, since the order form has a block for 24months, which you didn't tick. Thus, the 24month T&C's only apply once that box was ticked.

Ironically I never signed any papers. The whole process was done over the phone. I never signed any paper. I did, however, make sure that it was not a 24 month contract and I was clearly told it is not. I do think that this is going to become a nasty process, but I have already emailed Telkom twice without even a confirmation of email. I have logged a complaint at hellopeter also. If that does not work I will take this a bit further.
I posted a complaint on www.hellopeter.com and Telkom responded within 48 hours (strange, that they never responded to the two emails I send them directly). In the email I was told that I must please provide more information, which I did. I received another email a few days later stating that my problem was "escalated to the relevant department for further investigation." Not sure what this means, but I will post if I receive more info.
I'm in this same situation now. When I asked Afrihost to migrate the line, they said they can't, because it's under contract. I didn't ask for a 24 month contract, and they never said it would be (I applied over the phone, 10210). It's taken me a month so far, and still isn't resolved.
Mine still hasn't been sorted out, also a month later. Starting to suspect that Telkom is deliberately trying to block the migrations to Afrihost. They agreed after much back and forth that there is no "contract" but then said that they have to send it to their legal department or something - nothing has happened, weeks later.
I just emailed them again today to ask what is happening. Strange, but I am happy with the service from Telkom at this moment. No desire to move to another ISP or have my line migrated. I just do not want to be locked up in a 24 Month Contract. I also signed up via telephone, but I explicitly asked on a previous call if this was a 24 month contract, and I was told it is not. Unfortunately I cannot remember who I spoke to on that day, but it was about two days before I phoned to sign up. I was checking out a few things. Now I am sorry that I did not requested this info via email. At least then I would have it in writing. But I am going to fight this.
The way I read the T&C, the 24 month contract must be signed/agreed to prior to availing yourself of the bundled goodies. The T&C does not automatically convert the whole thing into a 24 month contract.
If you ticked "24 Month contact" option then you would get the 'free modem', if you do not tick the "24 month contract" option then you cannot claim the free modem.
Ha ha ha ha ha ha ha... can it really be this simple?I followed Grimstoner's advice and phoned them. I never thought about this since I had problems in the past with the telephonic personnel. I spoke to the lady and she was extremely professional. After a few minutes she gave me a reference number as proof that my 24 month contract was cancelled, the rest remains as is. I will wait for my next invoice to arrive before popping the champagne, but at least this went flawless. To the others: try this, it worked (so far) for me.
I do not know. They simply phoned me and told me the 24 month contract has been cancelled. They said nothing of the modem, and I did not ask
. They can always make an appointment to see me and get the modem, if they really want it. Anyway, they did not give me one of the best modems in the world - I got a DuoPlus 300WR. If they come and take it, I will have to buy another. It would be sad, but no train smash
