Thread: Traffic Fine

    Default Traffic Fine

    I think I'm in deep. Received a fine today dated 26 April 2011. Apparently I drove 125 km/h in a 80 zone. This happened in PE. Court date 4 Des 2012. Will these lads (Clerk of the court) negotiate a fine or will I have to travel 1200km to go to court? Would really appreciate any info.

    Your date of "Received a fine today dated 26 April 2011" is this correct or is it 2012??
    Secondly if the date of the "trapping" and the date processed is over 30 days the fine is invalid.
    Thirdly if this is 2011 I don't think the courts would recognize it as the time period is too long.
    I would fight it in court which probably won't even occur as the clerk of the court, if he/she has any brains, would throw it out.

    Write to the Public Prosecutor at the court where the hearing it to take place. Unless you have made a typo, this is not valid since it is too old. If you did, explain that you live 1200km away and would he be prepared to offer you some discount. Also apologise for speeding, but don't make a lame excuse.

    The date as stated is correct. "2011".

    If you don't get notice within 30 days if it's personal, or 40 days if it's a company, AFAIK it's not legal.

    As mentioned above about the fine being legal....

    Since the speed you drove was noted down as "do not collect R200, go to jail immediately" and is thus a court appearance, they wouldn't send you a fine but would rather as you have received, send you a summons to appear in court. I asked someone about this and the answer "the reason why you're only getting it now is that's how long it took to process it and send you the summons". It will still be perfectly valid.

    As to your question, I'd say it's best to phone the traffic department in PE and ask if there's any other possible solution to you driving down to PE.

    Thats ridiculous. Makes me sick. I never thought its backlogged to over a year, 4-6 months I can understand but a year geez..

    I think there is a requirement that the fine gets to you latest 6 weeks from date of offence or it is not valid. I think I heard something like this.

    Yes I also heard that a lot of times. But I don't think this is just a good ol AARTO fine. I think its a court summons.
