    Default private sale - who pays for the roadworthy certificate (RWC)

    I'm currently selling my car privately, who pays for the roadworthy certificate (RWC)?

    I already have the registration doc and transfer of ownership (yellow form) ready.

    Also, does the buyer or seller take the transfer of ownership (yellow form) to the licensing department?

    no seller will agree to pay for it unless its his way of trying to 'market' his car. normally buyer has to get it roadworthy and get certificate and the licensing done.

    I agree that it would make more sense that the seller should pay. If the car is roadworthy should it really be sold? Unless the car is sold 'voetstoots'. The buyer might just end up paying for the roadworthy only for the seller to sell to somebody else. You also can't expect every buyer to pay for a roadworthy in the event of something going wrong with financing.

    When a car is financed through the bank, the seller has to roadworthy the car. The bank won't finance a car that has not passed roadworthy.

    If you sell privately, and specify voetstoets... it's the buyers problem if they are dumb enough not to specify a roadworthy must be done.
