Legalised racism. That's all this is. This and affirmative action.

    Actually Nicodeamus is right.

Legally the state cannot prove anyone to be any particular colour as there is no pencil test or similar test to determine "colour". They would have to re-introduce apartheid era pencil/test type of laws to determine someones colour.

This would be a MAJOR step backwards and a clear indication that the SA Government is not a democratic society and will also show our constitution isn't effective...

An email from someone who is a struggle hero, been nominated for 2 nobel peace prizes for his anti-apartheid work, is a lawyer and was involved in the CODESSA process (formation of SA bill of rights and constitution) had this to say on BEE/AA

"The most extraordinary thing about BEE/AA is that everyone plays the game. There is no race classification law so every employer can say employees are whatever race s/he wishes. They can say, for instance, they're 100% compliant.

That everyone (as far as I know) is complicitous, means they get what they deserve.

Since no one has challenged to law, and since everyone seems to salivate at the thought of compliance, we as libertarians might assume there's consent, thus liberty. Maybe not exactly, but close.

By the way the Constitution forbids racial and other discrimination except for a single sentence exception, which may be only vertically applicable (ie applies only to government):

"To promote the achievement of equality, legislative and other [ie similar] measures designed to protect or advance persons, or categories of persons, disadvantaged by unfair discrimination may be taken."

Note inter alia that (a) there's no reference to race or (b) historical discrimination, and that it applies individuals and categories (which can hardly be said to be 80% of the population), and that the disadvantage must be present (in both senses of the words).

It seems clear that "unfair" discrimination (including all "horizontal" discrimination) is unconstitutional, yet no one has the guts to say so.

My expectation is that the first person to oppose new apartheid will be a black victim. "

This is racism at it's best and will continue to force racism to continue and spiral to new heights.

Slowly slowly becoming Zimbabwe in terms of economic enterprises, with the word enterprises not actually being what it stands for.

Every day I find myself becoming more racist due to this sort of racism I have to ward off and fight as well as the tw@ts we have ruining the country and their continuous truths coming out of the closet, as well as the stupidity.

One wonders what laws will be in place when my son goes out looking for his first job in 17+ yrs time, I somehow looking at Africa and black peoples successes as a whole don't think they will ever achieve anything on their own, I hope i'm mistaken.

dude, this is liek saying you become more and more homophobic every day because of gay people taking more liberties in public. a bad thing is a bad thing. you don't become more racist without being racist, you don't become more homophobic without being homophobic.

you can be sensible and outraged without being a racist

The blatantly racist laws of apartheid have been replaced by a much more subtle form of racism: Racism 2.0
