Legally the state cannot prove anyone to be any particular colour as there is no pencil test or similar test to determine "colour". They would have to re-introduce apartheid era pencil/test type of laws to determine someones colour.
This would be a MAJOR step backwards and a clear indication that the SA Government is not a democratic society and will also show our constitution isn't effective...
An email from someone who is a struggle hero, been nominated for 2 nobel peace prizes for his anti-apartheid work, is a lawyer and was involved in the CODESSA process (formation of SA bill of rights and constitution) had this to say on BEE/AA

That everyone (as far as I know) is complicitous, means they get what they deserve.
Since no one has challenged to law, and since everyone seems to salivate at the thought of compliance, we as libertarians might assume there's consent, thus liberty. Maybe not exactly, but close.
By the way the Constitution forbids racial and other discrimination except for a single sentence exception, which may be only vertically applicable (ie applies only to government):
"To promote the achievement of equality, legislative and other [ie similar] measures designed to protect or advance persons, or categories of persons, disadvantaged by unfair discrimination may be taken."
Note inter alia that (a) there's no reference to race or (b) historical discrimination, and that it applies individuals and categories (which can hardly be said to be 80% of the population), and that the disadvantage must be present (in both senses of the words).
It seems clear that "unfair" discrimination (including all "horizontal" discrimination) is unconstitutional, yet no one has the guts to say so.
