Lease agreement for vehicle was entered into without consent or knowledge of spouse. Couple were married in community of property.

I know for hire-purchase it's illegal, not sure about leasing though.

Would your wife have said no if you asked her to sign and you went ahead anyway?

It won't be possible without defrauding the system in hire-purchase because both need to sign on the dotted line and itc scoring of both are required.

If she didn't sign the contract they are not allowed to grant the finance. Both parties must sign when married in COP. You cannot buy anything on just your name.

They need payslips, id, fica and do ITC scoring on both parties.

This is Wesbank taking a monumental chance in my opinion...

Agreement is nul and void. However, bank will try and argue that the debt falls to the remaining party, but this is unenforceable

I bought my wife a new car in November last year, financed through Wesbank and she only found out when I parked it in our driveway to surprise her.

I think they ask you for your spouses details and whether they know you are entering into a finance agreement.

Married in community of property? And if so, all you have proven is that this is not the first case where Wesbank does not comply with the law (if what the other members have said is correct).

this has been done. bank is threatening to reposess vehicle (which wife has no problem with) BUT ALSO still hold her liable for the balance of the loan amount after car is auctioned. Now what?
