    Beleaguered Blogger Battles Timeshare Bullies

    A South African blogger has been hit with a R 461 500 defamation case after he blogged about his experiences with a timeshare company. “They phoned to say we’d won a car, and when we got there we discovered we had been lured to a timeshare sales pitch under false pretences. This happens to dozens of people every day, and now that their secret is out on the web they’re trying to bully me into keeping quiet about it,” he said.

    The author of the “Insights and Rants” blog has called on fellow bloggers and the public for help in fighting the case brought by the Quality Vacation Club, a timeshare company in Pretoria.

    ‘So far the lawyers have run up costs of R 55 000 against me, which they expect me to pay’, says Donn Edwards, the defendant. ‘They insist I spend more money hiring Attorneys who in turn have to hire an Advocate because this is a High Court (aka Supreme Court) matter. They effectively want to punish me financially even if they lose the case. That’s not to mention all the time wasted dealing with legal documents and worrying about the case. It’s affecting my ability to earn a living, and my ability to focus on my job.

    ‘I have decided to defend the case myself, so I’m appealing for information: anyone who has been phoned and told they have “won a prize” and was invited to a “prizegiving” that turned out to be a QVC timeshare presentation is urged to support the case by sending me an affidavit, describing what happened, good or bad, and whether they witnessed anyone being presented with one of the advertised prizes. The pro-forma document for the affidavit can be downloaded from my web site, and once the document has been signed it can be faxed or emailed to me.

    ‘I am alleged to have made untrue and misleading statements about QVC as a result of my own experiences with the organisation, and I stand accused of conducting a “campaign of defamation” against them, which is nonsense.

    ‘It is outrageous that a company of this size should think they can get away with sending me a summons out of the blue without even the courtesy of attempting to solve the matter out of court. They are on record as stating that they consider a court case their only course of action, which I strenuously reject. All attempts to settle the matter out of court have been rebuffed by the lawyers, who won’t even return my phone calls.

    ‘The case is fundamentally unfair on a number of levels, and I wonder what they hope to achieve by it. They are suing me for several years’ earnings before tax because of the alleged loss of potential sales, and because 15 existing QVC members have not paid their Management fees, supposedly as a result of statements I made on my blog. It would be bizarre if it wasn’t so serious.’

    ‘If big companies are allowed to get away with this kind of harassment and intimidation, then all bloggers are at risk every time they express any form of criticism that any trigger-happy corporate doesn’t like.’

    The primary focus of the blog has been technology, and the most popular articles all relate to “The Great Defrag Shootout” which reviews most known defrag programs for Windows users. Beginning last year Donn wrote a series of entries about his encounter with QVC, the company responsible for calling his wife to say they had “won” a car and were being invited to a “prizegiving presentation” to collect their prize.

    ‘I left the sales presentation (on Tuesday 4th September 2007) frustrated and upset about being lured there under false pretences, and naturally we left without any prize at all. Neither did I witness anyone else winning any of the prizes promised, nor were the prizes on display.

    I subsequently discovered that there was no “Win-A-Car Competition” when I asked to see a copy of my entry form. The call centre admitted that they had just phoned me from a list of numbers. I instructed them and QVC to place my number on their Do Not Call list, which they agreed to do. In spite of this I was called again six weeks later by another operator, who once again told me about the “prizegiving presentation”.

    I complained to Mr John Meyer, the Chairman of the QVC Management Association, and numerous emails and phone calls ensued. He initially offered a meeting but by November 2007 he was unavailable for a meeting. He promised to review the marketing methods used by “the developer”, whom he declined to name.

    In May this year I was contacted by “Prestige Business Solutions”, again with a similar story about having won a prize. I did a Google search while on the caller was still on the line, and the HelloPeter.com web site indicated that other people has been called, and that it was a timeshare sales tactic. I wrote about it again, and complained to QVC on the HelloPeter site. Again Mr Meyer declined a meeting, this time in July 2008. I heard nothing further from QVC until late October 2008 when they launched a High Court application, accusing me of a “campaign of defamation” being conducted on my blog.’

    Over 250 comments have been added by blog readers. Clearly this blogger is not the only person outraged by the false promises made by timeshare “competition” call centres to members of the public. ‘I appeal to fellow bloggers and the public to help me put an end to this odious practice once and for all.     Sounds familiar...

    Looks to me as if all he did was post about his experience. If that has a negative impact on the company, then they need to question the way they operate. It highlights how absolutely shocking their business principles are.

    If they made you think you had won a car when they knew that was not the case, and then they crushed your hopes, im pretty sure you can sue them for emotional damages.
    That would ruin my month and destroy some of my trust in the human race.

    On a serious note, they're just bluffing. People are too easily intimidated by the idea of 'legal action' when 80% of the time it's just a scare tactic. There's absolutely no way their case would ever get anywhere in a court, not to mention the damage it would do to their 'reputation'.

    Unfortunately it is already in court. They obtained a High Court restraining order against me (Witwatersrand Local Division Case No 08/35680) and now I am being persued for R1,5 million or R 461 500 depending on which figures you believe.

    What they didn't count on was that I will defend myself, and I intend to do it very thoroughly. I just hope these timeshare people have also badgered the judge and his friends as well <evil grin>

    There is a big difference between robust criticism and defamation, which they seem to forget.

    You guys can help by telling all your friends about my plight. Already a friend of an IT friend has told a reporter at the Sunday Independent about it, and I was interviewed this week. I think the blogger community and IT community could kick up a big fuss about these guys. They were trying to shut me up, and it could backfire if enough people get to talk about it.

    I'm a programmer, not a lawyer. I have a real job, and I'm asking you guys to help.

    I certainly will. I'll read through the entire blog soon but I can't seem to find the exact name of the company in question?

    I'm pretty sure they won't get their way with this though.

    Just read all the relevant blog posts and I'm absolutely disgusted at QVC's actions and also at how the legal system seems to be on their side. The way they come up with their 'loss in sales' is a total joke. I can only imagine how frustrating and intimidating it must be to have to deal with all their nonsense as an individual (the seemingly unavoidable legal fees etc.).

    You mention that you're not accepting donations but perhaps something could be organised through the forum to help raise money for that? After all, it's something that affects us all. Either way, would be glad to do my bit.

    you should contact the guys at the freedom of expression institute(www.fxi.org.za) .... maybe they can assist ... I think they are meant to help protect our rights/freedoms .... and from the sounds of it, this seems like a right to free speech matter ....

    I have also been duped by a similar scheme from another timeshare company .... and it seems like they really out in full force these days .... see them almost every time I fill up at the petrol station ...

    Don you have nothing but my respect for standing up to these corporate bullies.

    I'm sick of consumers being taken advantage of in South Africa, and then being threatened with ruinous lawsuits. It's a ludicrous situation. They should face some kind of legal sanction for this kind of bulying - well at least something that will make them think twice before going ahead with these tactics.

    btw- what are the details of the restraining order?

    "The Respondent is interdicted and restrained .. from in any manner publishing any defamatory material of or concerning the Quality Vacation Clubs and/or any of the Applicants."
    This is a little tricky considering they won't say what they regard as defamatory, but their court papers (which are part of the public record) have all the juicy bits. They can't stop me from publishing the court papers, except by asking the judge to make them secret, which they haven't done.

    While I'm in "legal mode" I have decided to file a complaint about their web site not complying with the Promotion of Access to Information Act, as well as filing a complaint with the Timeshare Institute of South Africa, and asking the DTI to rule their competitions an unfair business practice. If they'd just left me alone this would not have happened.

    Please, if any of your friends or family in Gauteng have been told they are "winners" but didn't win anything, then section 13.10 of the TISA code of conduct applies, and they should file a complaint:

    13.10 Members of the public may not be referred to as ‘winners’ told that they have ‘won’ an item, or be informed that the item is a, ‘prize’, ‘gift’, or is ‘free', unless this is factually and undisputedly the case.

    Good on you Donn.

    How did the Judge manage to grant an interdict? Based on what evidence?

    I just don't see a damages case here. The problem is proving actual damages and the company is making wild arse assumptions. I hope you win this and teach them a costly lesson.

    It's a "temporary" interdict, pending the outcome of Witwatersrand Regional Case No 08/38597 which I filed notice of intention to defend. Since the case is only likely to get on the court calendar in 2010 it feels pretty permanent.

    As for evidence, there is none. Just the say-so of a man who states in his affidavit that the statements are defammatory, but also says that he doesn't have to state which statements are defamatory or why.

    Read it for yourself: Case No 08/35680 and tell me if it makes sense.

    I hate this,

    My mom was promised the same thing only to spend a afternoon sitting listening to their timeshare KARP, and we never won nothing...

    Although they did do this little lotto thing where if you pulled out the correct balls you could win but now that i think of it it could be rigged

    Is this the whole Public Record

    Oh what a tangled web they weave...I think Qualitys' trust/section21/PTY smoke and mirrors show can ONLY be the end for these clowns if, and that's a big if, it does make it to court. Obviously they sought to intimidate little old you, because you were just not good for business, but I think this has backfired on their face
    I'm certainly going to be looking forwards to seeing that Lawyer Feldman try and squirm his way out of this one in a court defending this crowd. Whatever was he thinking when he took their case. The mind boggles.
