what were they hunting with? and whats the penalty for hunting without a license/permit? do they get charged with that as well as trespassing?

if they had hunting weapons did they use it against the outoppie?

Not a citizens responsibility or mandate to take out criminals.

A criminal can murder your wife and according to the law you're still not allowed to drive after them and shoot them while they flee.
Capital crime - you may use any means to pursue and arrest said perpetrator

If you enter someone's yard and just stand there, its not a trespass. Person needs to asked to leave, and give enough time to leave. He refuse, only then you can trespass him. Why? There is always a tacit consent to enter that you need to revoke if needed.

If you enter someone's yard and steal something, break something, murder someone, you are there with unlawful intent. You are charge with the crime, plus the trespass.

To get an automatic trespass, you first need to get them on a crime, which is why i said the toppie should've reported the hunting, which was most likely illegal

No, the law doesn't work that way........ entering the premises was/is illegal, whether or not you were caught. Murdering someone and NOT getting caught doesn't mean a crime hasn't been committed, you don't have to be caught in the act "In flagrante delicto" for a crime to have been committed.

You are still guilty of a crime regardless of secondary crimes, you can still be charged after the fact "ex post facto". However the law does make provisions in certain instances where in some instances some crimes prescribe. In other words whether you knowingly entered the land illegally or not doesn't matter. "Ignorance of the law is no excuse" applies.

Whether caught or not your still guilty of an offense. sigh.
 
Calling the cops, or not going after them when they flee the scene, he could've been saved from both.

But everybody wants to keep it real these days, even the 82 year old toppies acting tough now. And it wasn't even his farm.
Did not read article, but only responding to your post. In South Africa, police dont respond. This is a fact, hence why people started getting armed response, who do respond.

typical thieves, they own their own farm and cars but they still come to a neighbours farm to steal his animals, this is the state of the ANC South Africa.
 
I have heard multiple stories about farmers shooting poachers dogs and getting into trouble , its crazy that people think its ok to just go onto another persons land and hunt / poach as they please and the law protects the criminal.

Im sure this old guy has just had enough and at that age a person just stops giving a ****.

Maybe about 5 weeks ago I had a chat with one farmer from FS and this story is true, people nearby come over into the farms and steal maize, some strictly stick to hunting small game. Sometimes they ask for permission from the farm owner, sometimes not, but yes there is a lot of shooting going on at night in those areas. There is one advantage in letting them hunt but I forgot what it is, apparently there is still alot of game in the FS, its not all vast empty plains, that's what shocked me the most
They mainly hunt porcupine, which are a pest.

We were called out to our farm by SAPS over a death on our farm. Poacher was hunting porcupine and followed one into the burrow. The ground above him collapsed and he suffocated to death. He was there some time before our guys found him. Horrible way to go.
