I really don't understand the logic that says bakkies, taxis and buses are exempt from securing passengers when a crash would kill far more than a sedan.

You need to analyse the situation in terms of whether they are fare-paying passengers. Buses are subject to strict licensing requirements, taxis less so, and open bakkies are mostly illegal and not fare-paying. Enforcement is the problem.

No news on the 'owner' of the bakkie, or the 'construction company' involved?

The Western Cape Minister of Transport and Public Works has called for an investigation into an accident which resulted in death of 10 people.

"I call on law enforcement agencies to fully investigate the cause of this accident. Information found on the cause of this crash must be used to improve road safety and avoid recurrence. One life lost is one too many."

Are they exempt? Every seat in the new taxis has a seat belt by law. Even buses. Or am I missing something?

In addition to the requirements of paragraph (a), no person shall operate a minibus or midibus, first registered after 04 September 2006,operating in terms of an operating licence, unless seatbelts are fitted for every seat in the motor vehicle.

Midibuses require licences if they were registered for the first time from Sep 2006. That is basically a bus with 17 to 34 seats. Bigger buses do not require seat belts.

This is legal by what logic ?

247. Circumstances under which persons may be carried on goods vehicle
No person shall operate on a public road a goods vehicle conveying persons unless that portion of the vehicle in which such persons are being conveyed is enclosed to a height of—
(a) at least 350 millimetres above the surface upon which such person is seated; or
(b) at least 900 millimetres above the surface on which such person is standing,
in a manner and with a material of sufficient strength to prevent such person from falling from such vehicle when it is in motion.
Provided that no person shall be conveyed in the goods compartment together with any tools or goods, except their personal effects, unless that portion in which such persons are being conveyed is separated by means of a partition, from the portion in which such goods are being conveyed.
