Advice needed regarding neighbor's barking dog

I live in a townhouse complex and have had it with a barking dog.
The neigbours dog is a little white lap dog, looks like a common bichon that is kept outside during the day and night.
They only let it in when they feel like it.

It barks many times monotonously and at very high decibel levels for long periods every day.
It is irritating and loud.

I am across them and when the dog barks I see at what it's barking at and it is pointing towards the sliding door looking inside wanting attention/to be let in. They only sometimes close the see-through lace curtain even when they go to bed so the dog always is looking towards the inside and has learnt it has to bark to be let him or get attention.

The neighbours had this dog for a long time so the dog has been trained to behave this way it's not like a phase it is going through. It's just especially bad this winter and I have had enough.

The barking is the worst after hours and on weekends but they have become accustomed to ignoring it. How with that loud barking I don't know. They might on occasion tell the dog to keep quiet after a few minutes but they don't do it immediately. The barking is always when someone is there. It is irritating especially when it wakes me up at night at 10, midnight or 2 in the morning regularly or when I am working as the monotonous barking always goes on for a couple of minutes at a time.

My problem with it is that the barking is when someone is there and it's towards the sliding door not towards something externally. They normally eventually go outside or let the dog in but this only after a few minutes.

Tonight I spoke to them. They are a large Indian family and they give every excuse except the real reason for the dog barking.
The mother says a dog will be a dog and the dog barks at birds in the tiny garden which it might do on occasion but I told I can see what the dog is barking at and I have a problem with it barking towards the sliding door for long periods but she says when it does they tell it to keep quiet. They might but only after a long period of barking.
One of the daughters they say she is studying for matric exams so she can't give the dog enough attention as she should. When I spoke to them all of them the mother, father, daughters all defend the dog giving excuses.
The excuse they give for the dog barking towards the sliding door is that it hears a car driving past thinking it is a member of the family coming home but this doesn't explain why the dog barks for such long periods or when someone is right on the other side of the sliding door.

For the barking late at night they say they don't hear it as they are sleeping.
There is no way they cannot hear it they obviously just ignore it.

After speaking to them the father even has the audacity to ask me if I dislike dogs so they obviously not thinking about how the barking inconveniences me. Even today the dog barks multiple times at the door. Even after speaking to them it happens an hour later again they take their time to open the sliding door despite all of them being on the other side. I feel they are intentionally being spiteful. This is a large Indian family in a small town house with a little garden all of them ignoring the dog barking. When I do look at them through my kitchen window putting my hands in the air because they ignore the dog they act all childish taking a photo of me and laughing. When I continue looking at them they turn off their lights as they don't seem to like me looking at them and only turn it back on when I leave although they have no qualms about privacy and not having any curtains even the lace curtains are kept open with the lights are on late at night.

No other neighbour have complained formally and they fall for the barking at birds excuse but from my window I can see the dog is barking at the door.

I don't feel like going to the body corporate as I hate politics and they obviously don't want to admit the true reason for the dog barking. It has becoming enough of an incovenience for me to do something about it and it won't get any better the rest of the winter.

Some questions I have
1. The decibel levels the dog barks at for a prolonged period is something else. Can I measure it and have the dog declared a nuisance if it is above a certain level?
2. Since they are refusing to admit they are ignoring the dogs barking to be let in can I put a video camera on the window sill and prove they are not being truthful as for the reason for the barking or is this invasion of privacy since they don't use curtains. Can I put this on youtube or stream it?
Even If I don't record but it is visible it might cause them to get a non see through curtain so the dog can't see inside.
3. Should small breeds like Bichon be kept outside at night?

I suggest speaking to the body corporate and maybe get your neighbors to chat to the body corporate as well. Make sure you keep written track of the communications. You may not want to get involved with the politics as you said, but by not reporting the problem to them you are actually saying there is no problem. Reporting it builds up a history and pattern. I wouldn't recommend you filming and streaming videos unless you talked to a lawyer, you are opening yourself up for a world of hurt on that one.

You can report excessive barking to the SAP as this is noise disturbance or to the SPCA. A dog that barks as you mentioned is lacking attention and to just be closed outside such as you say it should have shelter with a bowl of food and water. This does not mean you do not care for animals at all. Rather for your sake and the animals sake report it.

1: Written complaint to Managing Agent/Trustees.
2: Metro Police. Barking dogs are a noise complaint against the bye laws. Metro handle bye law complaints

SPCA for sure, but they expect the complaint to be in writing, via email is ok. I had a similar problem with the neighbour's dogs over the road. Bark, bark, bark, bloody bark, day and night. The woman-owner had the audacity to say that I was bizarre to be complaining as dogs must bark. After a few visits from the SPCA, and a letter or two from them as well, they moved away - after months of swearing and glaring at me though... they're probably causing havoc in some other neighbourhood now :(

At one stage I bought a water pistol and would shoot water at the dogs to shut them up. Would get a brief break from the barking, but a few hours later they would be at it again.

The sad thing is it is not the dog's fault, it is just learned behaviour - the owners are definitely at fault.

It's better than shooting it with a pellet gun. It can be used as a training method to discourage undesirable behaviour.
My dogs follow me everywhere but certain areas are off limits. A spray bottle with water works like a charm. They need only see the bottle to know that they're breaking a rule.

I wouldn't mind if our neighbors use water to quiet our dogs when barking incessantly. When we're at home our dogs are mostly quiet, unless something's wrong. They'll bark at the odd bird or cat, but they won't yap. Many dogs tend to yap when their owners are not at home, and it is fairly difficult for the owner to address that in training. A squirt of water won't hurt the dog, and can help much to teach the dog not to yap.

Read the BC rules. Most of them are very similar and basically say that dogs should not inconvenience or disturb any other resident so the reason the dog barks is largely irrelevant. If your BC is smart they have rules in place as well as fines as if there are no fines then the BC rules are in essence an honour code and are unenforceable. If there are fines just keep complaining and try to get other neighbours to also complain in writing. I know in our complex we tend to ignore noise complaints unless they come from two separate sources or units. Once we get two complaints we then know the noise is generally at an unreasonable level and issue a warning letter followed by a fine if it continues. Its a very effective system and we almost never have to go as far as fining them.

If you have security guards they can make a very effective "confirmation source" of noisy dogs especially late at night. We often try confirm with security when it comes to noise and pet complaints.

If you don't come right maybe take the dog to your yard (borrow) and give it the attention it needs, I can always tell when my dogs get cabin fever as they are naughty, a quick walk and they fall asleep.
