AfriForum’s Gerrie Nel to represent Senzo Meyiwa family in court

Lobby group AfriForum announced at a media briefing on Tuesday morning that it will be representing the family of late Bafana Bafana and Orlando Pirates goalkeeper Senzo Meyiwa in the investigation into his murder.

Head of the organisation’s private prosecuting unit Advocate Gerrie Nel has been appointed as the family’s advocate.

AfriForum says they are stepping in following the National Prosecuting Authority (NPA) failing to institute prosecution.

The organisation’s CEO, Kallie Kriel, said: “It is important that AfriForum gets involved in cases such as these – it’s in the interest of the whole country that the criminal justice system functions properly.

“AfriForum serves as a counterweight to the failure of the state, and as a civil rights watchdog, it is our duty to prevent the criminal justice system from collapsing.

In this case it a failing of the police not the npa, not sure how afriforum plan to remedy that deficiency.

They have excellent investigators who can collect the evidence needed.

They get a certificate saying the NPA won't prosecute, then they investigate and get the evidence required and then prosecute as a private entity.
Can they investigate and prosecute? It would be great if they're allowed to do both, especially in this case.

From what I know of course they can... once they've had the cert from the NPA that they don't intend on pursuing the prosecution, then its fair game for them.

Of course their investigation will need to meet strict evidence standards...

It is a bit ambiguous. They are not allowed to investigate but can gather evidence and have power of subpoena. The NPA and police must still help the prosecution with handing over evidence gathered and effecting any arrests needed to ensure accused attend court and so forth.

Wrong.

As with any private investigation, they are free to investigate, gather evidence and build a case. They can approach the courts for subpoena's to ensure all evidence are gathered in terms of the Criminal Procedure Act. They do not need to hand anything to the courts or police. All evidence will be going to the prosecutor and/or court who will adjudicate over the private prosecution. It will not be going to any other NPA member. In terms of affecting arrests once the investigations are complete, they will again approach the prosecutor who will issue a warrant, if one is needed. They will then have various avenues in which the actual arrest can be executed. But, in most private prosecution events, the court simply issues subpoena for the suspect to appear when the matter is ready for court.

This follows the family of Meyiwa, who was killed in a robbery five years ago in Vosloorus, approaching the organisation for help in bringing his killers to justice, after accusing the NPA of failing to make headway in the case.

Are you now butt hurt because they did tell them to f-off to fit your narrative and you could crucify them? Would you rather they never see justice to spare your 'feels"?

As for spite/show: what did your government do with Gabriella and Grace? Or the farm invasion at Onderstepoort?

But please leave me out of it.

You dragged yourself into the "political thing". Easy playing it at other's expense. However you are now free to drag yourself out and go find some trauma counselling.

All of that just to be wrong, I had not commented on this specific story if you had two brain cells to rub together you would have realised that post is from an unrelated thread,

The two bottom feeding maggots thought it was great idea to use this tragic event and Afriforum helping out to push some ****ing narrative.

So how about all you bottom feeders keep me out of your trip to use a tragedy to prove a point.
