AfriForum said on Tuesday it will prosecute a man who “falsely” accused his colleague of using the k-word against him.
According to the civil rights group, Sello Mojela accused André Fourie of racism after a disagreement in 2018.
The two worked for a plastic supply company.
Mojela apparently said during the employer’s grievance procedure that Fourie called him a “baboon”.
AfriForum’s deputy CEO, Ernst Roets, said Mojela changed his version of events when he opened a criminal case with the police.
He then said that Fourie called him the k-word, Roets said.
In response, Fourie opened a crimen injuria case against Mojela after being fired.

Doesn't firing on hearsay render dismissals unfair?

Fantastic. Kudos to AfriForum. South Africa will descent into a full-blown war if it had not been for this fantastic group. They are needed to keep a rogue government under control. Their international efforts are great for the people of this country.

Fantasties, but sad that Afriforum must do the NPA's work.

Yes. Where the national government has failed, civil groups should take over that function and run it officially. Just like it recently happened in Harrismith with Eskom and North West with the water issue. We need to slowly start taking away these functions from a failed government.

“It is unacceptable that people who make false claims of racism are allowed to get away with it, while it has far-reaching and negative consequences for those who are implicated.
Many employers act harshly against false claims.

There may have been "witnesses" or the company acted unfairly.

If there are witnesses they'll will most likely take the stand in the crimen injuria case. Doubt there are witnesses though as Mojela changed his story.

I agree this looks a lot like they rushed to a decision. But one wonders why Fourie didn't approach CCMA for assistance.

It is strange, the CCMA is usually the first call of action after a dismissal.

Sad for the guy who got dismissed as his reputation is automatically tarnished.
Hopefully he wins a CCMA case against the company for unfair dismissal.
As for the idiot who lied, he needs to be with his racist buddies in prison. Racism and lying about racism are serious offenses.
