Funny how they claim it has nothing to do with Zuma, immediately after the judgement is delivered. This doesn't strike you as odd?

They are said this morning that the decision to ask Mbeki to step down had nothing to do with the Nicolson verdict. It just happened to occur directly after the judgement.

The main problem is, is that the ANC has gotten bigger than the game... and just like any other sport they are going to fall hard...

If the country meant so much for the ANC and Zuma they would not keep on pushing for Zuma as president if you look at what damage it will do the country if he should be president and then be in court the whole time.
The question is will they fall soon enough for the rest of SA to survive?:(

I am no lawyer either, I was merely applying my own common sense here. (I so wish the law guru's of the forums could come aboard now)...

Common sense tells me that the timing is no coincidence - they're trying to get Zuma off the hook and they're baiting all ANC supporters with this rubbish that the NPA have abused their powers or have too much power or whatever tripe they can think of next. Zuma was not president when he supposedly committed these crimes and must therefore expect no presidential protection, however the president should be accountable to the people, and so far the only group to show competency in doing so and nailing corruption high up in govt ranks is the NPA. First they tried to squash this by having the scorpions removed, now they want to remove power from the NPA. And you still think none of this has to do with Zuma, and is in fact merely the ANC pro-actively trying to resolve issues? Please! They're doing the exact opposite. They're intentionally fscking up the few good things we have for the sake of one individual who for some reason they have this undying love for - it's called propoganda. Nobody actually knows why they want Zuma, they just DO!

Another one for the coincidence box. And Mbeki fired Pikoli over the Nicolson report and now Mothlanthe won't re-instate him, even after the Genwale Commission suggested he was fired for the wrong reasons based on Nicolson's report and must be reinstated. The commission was a blatant public farce...

They really must think South Africa is inhabited by a bunch of idiots.

It won't happen. If this is disputed and hurled before the Con court it will not go through.

This is a pathetic excuse, the SCA judgement was unanimous, there's no real disagreement, the matter's been decided.

No way the Con Court will allow such a thing. This and the Scorpions thing is 2 completely different things. The moment the Con Court allows this to go through they are only hanging the court itself.

It won't happen. If this is disputed and hurled before the Con court it will not go through.

Unless they amend the constitution or do it within the existing framework. If its legal and constitutional the court has to go along with it.

There we go again debating speculation. The ANC said that it hired a lawyer to "review" (not amend) the NPA act. Now lets study the definition of review (refresh one's memory, e.g. "I reviewed the material before the test") and lets compare this to the definition of amend (An alteration or change for the better; correction of a fault or of faults; reformation of life by quitting vices.).

Now although the ANC accepts and respects the decision, it is no rocket science that they are not pleased with the outcome and that lead to them thinking there is a flaw in the NPA Act.

They did not say they are gonna amend the act, but review it! This reminds me of the days when people would sit the whole date discussing whether Thabo Mbeki should take up a 3rd term as president of the country...yet another speculation!!!

This sentence sums up everything that is wrong with the ANC and its supporters. If you think that this is how a country should be run then it highlights exactly how deep the propoganda machine has sewn its hems, and how detrimental it has become to South Africa...

with the exception of the high court judge Nicholson...

also...why has Motlante not implemented the recommendations of the Ginwala commission?

the law is currently open to interpretation and obviously different judges interpret it differently...

to me that's a flaw that must be fixed

Sure but its not uncommon for a higher court to overturn the decision of a lower one. The SCA judgement also implied that Nicholson's judgement wasn't based purely on the law and the facts at hand.

Who happened to be unanimously over-ruled by 5 supreme court judges who lambasted him for piss poor work and prejudice. I think I'll take the word of those 5 over his any day of the week. Not because they lambasted him, but because they unanimously voted and highlighted in a clear fashion why they made such a ruling. Unlike the Nicholson judgement which was wrought with either personal prejudice or motives...

In this case it doesn't appear to be an interpretation issue at all, but either one of total and utter incompetence, or ulterior motives. As was highlighted by the 5 SC judges...

You're looking for reasons not to see the obvious. This review process of the NPA has nothing to do with pro-active and beneficial lawmaking (do you honestly think it is?) but rather with Zuma's presidency in mind. And they're willing to blatantly lie to the public about it and potentially inhibit future investigations into corruption - just lain daft!!!

There are still people in rural Zimbabwe and a lot of people in the townships in South Africa that don't hold Mugabe accountable.

They are idiots, or very lean on the truth.

As for Zuma and the NPA, the ANC will stiop at nothing to protect Zuma, no matter what it costs our democracy.

Let the law run its course they say, when it runs a course they do not like, they change the law.
Scorpions gone because they sniffed to close the to the gravy remember.

Nothing wrong with appealing a judgement but there must be a basis for that appeal.
The ANC is wanting tp change the law to accomodate Zuma and prevent the NPA from investigating him further, perhaps because they realise that they have finally exhausted all the legal options they have.
