Secretary general of the messianic churches, Buyisile Ngqulwana who claims the African Transformation Movement (ATM) is the brainchild of ANC secretary general Ace Magashule and former president Jacob Zuma, says he is not shaken after the party slapped him with a R22m defamation lawsuit.

"Nothing is going to shake me because I did not commit any crime. I was telling the truth," he told News24 on Friday.

Ngqulwana claimed Magashule suggested the organisation should start a political party and Zuma was roped in to assist it.

This will be interesting - they'd have to prove that the claim is in fact a lie, and why would that claim be considered defamatory.

Mzwanele Manyi's African Transformation Movement (ATM) is suing the former secretary-general of the South African Council of Messianic Churches in Christ‚ Buyisile Ngqulwana‚ for R22m.


This is following Ngqulwana's claims that former president Jacob Zuma and ANC secretary-general Ace Magashule had helped in the formation of the party.


Manyi on Friday shared a legal letter addressed to Ngqulwana‚ demanding that he pay the party R22m it allegedly lost following the claims.


"The false statements you have uttered are to the effect that former president Jacob Zuma and ANC general secretary [Magashule] assisted in [the] formation of the ATM‚ our client. The same false and defamatory statements are contained in your affidavit filed in support of an application before the Electoral Court‚" the letter read.

Having withdrawn his ATM defamation case, the ANC leader may have to contend with a counteraccusation

The general secretary of the SA Council of Messianic Churches in Christ, Buyisile Ngqulwana, is turning the tables on ANC secretary-general Ace Magashule, who had filed a R500 000 defamation case against him – only to remove it from the court roll this month.

Ngqulwana was sued over his claim that Magashule was one of the people behind the establishment of the African Transformation Movement (ATM) as part of efforts to destabilise the ANC.

The matter was scheduled to be heard before the Bloemfontein High Court on Thursday.


However, a “nervy Magashule”, as described by Ngqulwana, removed the matter from the court roll at the eleventh hour.

Court papers dated March 3, and seen by City Press, confirmed that the applicant, Magashule, “herein removes this matter from the roll, which was set down for March 26”.

Ngqulwana, who was a member of the African Transformation Congress (ATC), which later changed its name to the ATM, told City Press that Magashule was backtracking “because he is afraid that the truth is catching up with him”.

“Magashule knows that there is no way he will win this case,” added Ngqulwana.

“In his application to the court, he said he had never met me and alleged that he had never made any donations to the ATM.

“I then submitted the bank statement and the email correspondence to show that his personal assistant had been in communication with me.”

She added that the matter “will be reinstated for a more suitable date”.

Surely they don't remove cases from courts' roll due to unavailability of counsel, do they?

Ace Magashule did not withdraw defamation case, say lawyers

ANC secretary-general Ace Magashule has not withdrawn a defamation case against Buyisile Ngqulwana, but requested a new court date.

This is according to Magashule's legal representatives, Victor Nkhwashu Attorneys.

The law firm released a statement on Wednesday after reports at the weekend said Magashule had withdrawn the case and was facing a lawsuit from Ngqulwana.

But his lawyers said Magashule was going ahead with suing Ngqulwana for defamation after the latter accused Magashule of being instrumental in the formation of political party ATM.

The ANC will launch an investigation into Ace Magashule's alleged involvement in the formation of the African Transformation Movement (ATM).

Three sources who have direct knowledge of events have confirmed to News24 that former president and ANC secretary general Kgalema Motlanthe will lead the investigation. His panel is still to be finalised but is said to include former speaker of Parliament Frene Ginwala.

Magashule is suspected of having played a key role in the formation of ATM, of which Mzwanele Manyi is the most prominent member. It's even believed that he recommended that the word "movement" be included as part of the party’s name.

Evidence detailing Magashule's involvement was apparently handed to the ANC's leadership by disgruntled ATM members ahead of the May 8 election in an attempt to have the party removed from the ballot.
