Nelson Mandela Bay ANC councillor Andile Lungisa's appeal against his conviction and effective two-year jail sentence has been dismissed in the Eastern Cape High Court in Makhanda (formerly Grahamstown).

Lungisa was convicted of assault with intent to do grievous bodily harm after he smashed a glass water jug over the head of DA councillor Rano Kayser during a heated council meeting in October 2016.

The incident was recorded on another councillor's cellphone. Kayser sustained serious injuries.

Judge Judith Roberson, with acting judge Feziwe Renqe concurring, on Tuesday dismissed Lungisa's appeal against both his conviction and sentence.

During conviction proceedings, Port Elizabeth magistrate Morne Cannon said Lungisa had proved to be a poor witness who changed his version of events as the trial proceeded.

Lungisa is on bail of R10‚000.

He was released in May 2018 after serving just 16 days of his sentence.

It was not immediately clear if he will return to custody. He has the option of approaching the Supreme Court of Appeal for reconsideration.
 
If he's like any other ANC criminal, he'll never see jail. We'll wait years for the appeals all the way up to concourt, with regular 6-12 month delays for every motion to dismiss or dispute something.

He's already served some jaik time for this assault and will rightly be back in jail soon.

Hopefully the Supreme Court and Constitutional Court won't hear his appeals.

Gives me hope for SA.
Apart from the Vaseline, he should invest in a puncture (slow) repair kit.
On the plus side for him, a qualification for further advancement in the ANC.
 

Mandela Bay African National Congress (ANC) Councillor Andile Lungisa has been suspended by the party for his conviction for assault with intent to do grievous bodily harm against Democratic Alliance (DA) Councillor Ryno Kayser during a council meeting in 2016.

Lungisa was sentenced to an effective two years in prison and is currently appealing the sentence.

He is among a group of councillors that the party’s highest decision-making body, the National Executive Committee (NEC), has asked to resign as they are facing criminal charges.
