Attorney and Transfer Fees

Hi, I'm in the process of buying a flat from a private seller (via Private Property). It costs under 450k.

The seller tells me that the Attorney Fees after the transfer will be under R8k (didn't specify). This really sounds like it's a hell of a lot? What would you advice me to do to get the costs lowered.

Please help

I could be sooooo wrong here,

but from what i understand if u pay under 500k for ur place there are no tx fees? 8k for lawyers fees actually does not seem that bad?

Under 500 no tranfers fee's? Something like that in any case:eek:

And 8k is not bad but ask for a cost account.

yeah like i said i think so, and i think it might only be for first time buyers...but i really am not sure about it.

If you are using a bond to purchase the property then you'll need to pay the lawyer about R8K on R500K for the bond registration which is separate from the deeds transfer and registration - you as the buyer chose the bond registration lawyer, but the seller gets to chose the deeds transfer and registration lawyer (I insisted that I chose this as a condition of sale). You can ask the lawyers on the banks approval list for discount.

I'm not sure about the waiver of transfer and registration costs for homes priced below R500,000 but shop around for a conveyancing attorney that's prepared to discount his fees - I got a 30% discount.
The conveyancer will only discount his fees which is relatively small compared with the costs that are paid to the deeds office.

Remember that for most sectional title properties, the body corporate will insist that the levies are paid up front for the first year, and six months rates paid in advance.

Here's an example of the costs on a transfer of a property valued at R1,200,000
The conveyancer only offered a 15% discount on this one.

EDIT: Remember, that if you do not have property to sell to finance your purchase and you have bond pre-approval from the bank, use this to drive a very hard bargain. Not making the sale of your existing property a condition of the offer to purchase carries a helluva lot of weight these days.

R8 000 sounds a bit steep to me too. I bought a flat for R550 000 four years ago and paid just under R4 000 for the attorney fees. Even with inflation, R8 000 is above average, I think.

Since then I've learned and will make it a condition in my next Offer to Purchase that the buyer and the seller need to agree on an attorney before sale. If you know a transferring attorning willing to give you a better deal, and the seller is also happy with that person, you could save a couple of R1 000.

Also, stay away from the large legal companies, and rather choose a small, but reputable business. They tend to be much more affordable, generally.

Apologies, just re-checked my calcs and with the posts, petties, FICA, VAT, municipal valuation and rate clearance,, the average cost of transferring (excluding bond registration) comes to about R8 000. Still, try and get your own transferring attorney to get a better deal.

Under R500 000 is supposed to be free transfer duty. The lawyers are merely there for all the paperwork.

8K doesn't sound too much to me but still try and negotiate as it's not that much work and they usually stuff it up the first time.
