I doubt it. It doesn't make legal sense. Going by what is made known the moment he told the police that he was buds with Eugene Terre’Blanche that they deemed him terminally ill, add his demands, and there is cause to have a psychiatric evaluation application made, it would all be deemed procedural. It was said in court that because he stuttered, that he could be mentally disturbed, which is odd... This is all going by what was stated in the court. The suspect stands by, being illegally arrested.

The suspect is either insane or trolling, but he is well aware about certain events.

Just know that he is trained by his legal council.

More evidence to come... and I hope that there will be enough time today to take everything under consideration, otherwise the proceedings are set to continue in the coming week.

The suspect is now making the argument that he won’t be welcome in Cape Town any more as he would be unable to make a living as nobody will tip him due to his situation and circumstances as people will recognise him as a criminal.

The prosecution is sticking hard by their terrorism charge, highlighting the consequences. The position is that the NPA don't want the suspect to leave the Western Cape on bail, and since the suspect has no attachment to the Western Cape, he would be a risk to leave the Western Cape.

Another break whilst the prosecution's evidence is being viewed. The NPA made the argument that the suspect is a danger to society, a danger to national security and is likely mentally ill, though the intent to have him evaluated was ruled as irregular, but not illegal, and that the evidence now being viewed will strengthen their case in opposing the bail application.

Other notes: The photo/video evidence still needs to be enhanced to better establish whether it is the suspect therein, and the suspect’s clothes still need to undergo testing whether it has been exposed to petrol. So I guess petrol is an element to the alleged ‘explosive device’.

Are the EFF now trying to cast the guy as some sort of freedom fighter?
Mafe apparently demanded that President Cyril Ramaphosa resign on 8 January and that convicted murderer Janusz Waluś be released from prison on the same day that late former President Nelson Mandela was freed from incarceration from Robben Island.

I think the NPA have reasonable evidence in their video material. Dali is very much opposed.

Oh my, the NPA must really have something credible on the suspect. Dali is back to his old boring ways, currently explaining the law to the court...

Dali even said they were ambushed by the evidence, though he did have a reasonable argument, as they couldn't consult the evidence with their client.

Check out this vid. In the first 30 seconds, you see him walk into the courtroom. You can clearly see he's out of it, he looks at everything with big, hollow eyes and he turns around slowly looking at everything as if he doesn't understand what's going on like a tikkop on a high or where he is. IMO there are grounds for mental health problems

Okay, so it is not clear whether it is the suspect in the video, it still needs to be enhanced and authenticated.

Here it comes, Dali is making the exact same Constitutional play as they did with Jacob Zuma. The suspect must have the right to a trial, including the right to be presumed innocent. Now, the prosecution did try to get the suspect incriminated through questioning which he avoided answering in any case arguing that he would answer those question in the trial, so well-trained by his legal counsel.

All I want to see is the video evidence...

Btw what's with the thing with Walus? Didn't he kill the SACP leader Hani in the 90s? Wouldn't he be the first the RET/EFF would want to take out then? Where does he fit in exactly?
The rhetoric (which is a bit nebulous), is that he was killed by Walusz and co. in collaboration with some in the liberation movement. The target changes as per prevailing political conditions.

The state have now opposed the part I have put in bold through established case law, so why could this argument not be made in regard to a certain other individual? Basically, being presumed innocent is only applicable to trial and not to pre-trial.

I do question the context in which it was argued though, sure the van Wyk case had its own context?

Adv Mpofu is objecting to the "ambush" of the State trying to show bits of 30 hours of video of a man they say looks like and is dressed like Zandile Mafe at Parliament around the time of the fire. Apparently includes a "confession" video. Bail app continues.

State's application to admit and play video footage of someone who looks like Zandile Mafe at Parliament, is refused. His bail application continues.

Prosecutor Menigo submits that Zandile Mafe has not show exceptional circumstances that warrant bail. He is doing his final wrap. Hopefully there will be judgment tonight.

Odd reporting there at the end, it is the Judge, or Magistrate in this case, who would determine the merits.
