BT Games and their policies. ADVICE Needed

My wife bought me a copy of Lords of the Fallen (PS4) pre-owned from Tygervalley yesterday. When she got home I told her I already own the Digital copy. She took it back this morning but they are unwilling to refund or credit us the full amount for the game. She paid R599 for it and they are willing to give us R120 for the game. Which we didn't even touch after purchase.

Surely this is illegal according to the CPA ?

If it's still sealed then take it back.
They can't refuse to refund you.

Yeh, that's stupid if anyone paid that.
If you did pay R600 for a 2nd hand game and it is within a certain time frame then I see no issue with returning it.

How does ps4 work though?
Can you just copy games like you could with a ps2 or ps3 direct onto the drive?
if so then I can understand why BT would have this policy.

Ps2 you could just rent a game from the DVD store and burn it to disk to play on a flashed machine or load the iso to the usb drive/external.
Not sure if ps3 & ps4 have this capability but if they do then I can understand why the guys would be iffy about returning an opened game.

PS3 does have the capability - if hacked.
PS4 does not yet.

Your right to retain and not pay for unsolicited goods or services
Consumers have the right to return unsolicited goods or services, at the risk and expense of the suppliers.
Consumers are entitled to retain unsolicited goods or services after 20 business days

Can I go with this approach and then ask for either the refund or credit ?

I'm afraid you have no recourse. The good was not unsolicited, as your wife bought the copy for you after entering a store on her own volition. The good is also not defective in any way. The CPA doesn't exist only to protect buyers, but also sellers. It would be crazy to compel all stores to accept returns for any reason within a certain period of time. The stores that have 7 or 14 day return policies do so to foster goodwill with their customers, and no other reason.

It boggles the mind that your wife would support a store like BT Games, and pay so much money for a second hand game. As a gamer, you really should educate her a bit about buying gaming products for you.

Your best bet is to head on over to a forum like SA Gamer, and see if you can trade your game with another forumite for something that interests you.

Unsolicited would indicate they sent you the goods without you requesting them, as I understand your wife went and asked for the game. That does not qualify as unsolicited.

I am not aware of a provision for your situation, but I could be wrong.

Your best bet is to try sell the game in classifieds and try recover as much as possible but I really doubt you will get R600.

Im sure if you beg and plead to the owner of BT games. He will sort it out.
