Buying a contract phone from a person without papers

Hi

Just wanted to know if the warranty on the phone would still be exercisable even if I don't have the required papers - would they be able to find the phone in the system ? It's under a Vodacom contract

Technically the phone belongs to Vodacom. If the contract seller stops paying, the phone will be blacklisted and you'll be out of pocket.

I seem to recall it being said that VC's policy in terms of the sim in the phone has to be the contract one, using another voids it.

But that was long ago, so not sure what their policy/POV is now...

They say a Vodacom sim must have been used in the device within the last 90 days, so doesn't have to be exclusively Vodacom sims.

From my experience as long as the handset is under warranty they'll fix it, I've taken a previously jail broken device into Vodacom and they didn't bat an eye lid. They have never requested pop, they use the serial number to check the warranty status.

As has been mentioned with a contract phone the real risk is the seller not paying the contract and handset then being blacklisted, but from my experience that's not very common, though it's better if you know the person you are buying the phone from or know of them to be reputable.

Do make a sale agreement though, with wording to the effect that the seller is saying the phone belongs to them, if it gets blacklisted due to non payment then you open a case of fraud.

Also consider the risk, buying a contract phone for over R4k from an unknown person is taking a real chance, R6-10k is starting to really get very dodgy, a blacklisted phone is essentially permanently bricked... Some people do it though, of you can afford the risk I suppose then why not.

I am now also concerned. I have swapped two of my own devices for other devices. Now my concern is that the devices I now have may be blacklisted due to non payment on the other persons behalf. Nothing has happend thus far, but Im thinking I should trade in my 6s at the iStore and sell my P8 Lite just to get it off my hands. Im concerned now

Trading in a contract phone is fraud. Also trying to fob off devices you thing will get blacklisted to unsuspecting buyers is super scaly.

If the people you swopped the phones from are decent reliable people I can't see them not paying their contracts, being blacklisted makes your life a bit of a misery, rational people typically don't go there, unless they have a habit spiralling out of control gambling/drugs...

The T&C's clearly say the asset is only transferred to you once fully paid for.

Given that the person owning the asset (ex. Vodacom) is also the one controlling whether it can function on their and others networks ... its probably not a good idea to take a chance because if they're still looking for it and/or the payer who's defaulted it can be a problem for you.

Ja only thought of that situation now.
On the iStores website they actually say you can trade in your phone after being 6 months on contract.
Will never trade a phone again in the future. Hopefully the people are reliable and still make there payments down the line.
Im not concerned that they wont pay their bills but its always a possibility because you cant trust anyone these days

That iStore trade in deal is for if you got the phone from a contract you took out in your name and possibly needs to have been through them as well.
