You are correct. It is actually estate duties and not donations tax. Still 20%, but there are some details that will differ in the estate (like the first R3,5m is tax free).

Also forgot that spouses don't pay taxes on donations to each other. Wonder when that will change

Changing the spousal arrangement will be a nightmare. Besides, why would anyone want to change that?

There's is no rationale for taxing transfers between spouses. Both are taxed on their incomes individually, what would be the motivation for taxing transfers between them.

I.e. I transfer R50k to my spouse who uses that to pay the kids' school fees. What is the taxable event?
