Car Insurance claims: Problems with 3rd party phoning me frequently ....

I need advice on how to approach a situation I'm having.

In November, I made my first accident with another vehicle. I was at fault and the 3rd party does not have any insurance. I did all the admin on my side, so I opened the case, made a claim for myself and told the third party that they need to register a claim for their own damages.

Now the problem that I am having is that this 3rd party is phoning me regularly and asking me when the claim is going to be done. Sometimes they want me to send documents on their behalf to the insurer, e.g. today they wanted me to fetch the accident sketch from the police station and send it on their behalf (in my mind i was thinking 'what a load of crap'). Yet my insurance company says they have to draw their own sketch to compare my version to their version of the accident.

Did anybody experience this kind of thing before and what can I do about it? I presume that I can't get into any legal issues with this kind of admin problem?

I am of the opinion that the 3rd party shouldn't contact me at all because they can deal with my insurance company. But ya, this is my first accident so I don't know if my opinion is correct or not.

For statistical purposes, my insurance company is budget insurance.

When I had an accident (that was my fault) I had the same problem after going out of my way to help him. Phoned the insurance company for advice and they gave me a number for the 3rd party bloke to sort out the claim.

Whenever he called me I gave him that number. He eventually got the point.

You are under contract with your insurance company that states you shall not negotiate with 3rd Parties. If you do, you are in breach of contract.

Hang up on the 3rd party. Or say "Don't talk to me, talk to my insurance" and then hang up.

Tell him to piss off and deal with your insurance company.

Lodge your claim, get your car fixed and stop dealing with him at all.

You are 100% correct. The 3rd party must deal with your insurance.

The insurance company will deal with the claim.

When I had an accident in 2013 it was my fault and his insurance even sent me a lawyers letter trying to claim it from me. I forwarded the letter to my insurance who got their lawyers involved and told the third party that they do not deal with me but them instead. Get your insurance to deal with this you pay them for this reason.

You can try deal with me directly, I'll tell you to **** off - you can call as much as you want to hear me say that... until I get bored and open a case of harassment at the police station... besides that, if you don't have insurance, then that's your problem - not mine.

The insurance company will deal with the claim.

The insurance company will just get there legal department to send you a letter instructing you that you or your lawyers must deal and correspond with them directly. If you continue to contact the insured, it turns into harassment.

Same thing with me. The response from my insurance after I forwarded the threatening email from 3rd party's insurance was that I must not respond in any way to those lawyers, and that they'll deal with it. My insurance then copied me in the email telling 3rd party's insurance and lawyers to shove their claim up their arses and that they should claim from the municipality.

(my accident was a result of hitting a pothole full of water just before making a turn at a robot. This burst my shocks and I lost control when I took the turn, hitting 3rd party's car).

Edit: I took tonnes of pictures. Including those of the burst shocks after they were replaced. Always take pictures.

Because when you take out motor insurance the risk and liability to make good rest/shifts to the insurer.(up to the amount insured).

They also have lawyers etc that are employed to render a legally correct verdict.

You negotiating with the other party is usually expressly forbidden.

Do not under any circumstances draw or submit any documentation to your insurer that must be done by him.

you get the number for your insurance legal dept and when he calls say sorry you cant take his call, please call the legal dept at this number for any queries he has.

Because that is why I pay fully comprehensive insurance every month.

Comp insurance means that your insurance will stand for your rights, there are even lawyers at your disposal should it be required.

your vehicle is your responsibility. If you had comprehensive insurance, you would go to your insurer. They and their teams would stand for you. Your insurer will ask you an excess. The excess is fully refundable once your insurer is paid by my insurer.


In part that is why I like the UK laws regarding insurance. Each individual must have their OWN insurance, and driving without it is illegal

Not your problem...you can give them the insurance claim number and they can arras the insurance company until it has been solved. You have done your part.
