Cell Warranty - Faulty Z3

Hi

My Z3 compact seems to have died on me. Sent it in to Vodacom and got an sms saying it has been exchanged. Not sure what taht mean so I want to know if they are allowed to swap out my phone for another second hand unit or if it will be a new unit?

I really don't want a refurbished phone....

My z1 compact died three months before warranty ran out and they replaced with a z3 compact - new phone. No complaints :D

Lol, doubt they will replace it with a z5 compact.

What Im asking is, are they allowed to replace it with a refurbished phone?

Just checked the website and it says they will provide a refurbished.

How can I fight this? I don't want a refurbished, I would much rather prefer they repair my phone.

The cell companies are skirting the CPA by saying that they haven't sold you a phone. You are leasing it for 24 months then its yours.

If you purchased the phone outright then they have to give you a minimum 6 month warranty. If the produce is faulty inside of 6 months you (not them) have the choice of one of the 3 R's; replace, repair or refund. They can't force you to take the option they choose.

But if the phone is part of the contract , ie they supplied the phone to you, then they can do what ever they like. Its their phone until the day after the last day of the contract.
