Consumer Protection act against Playstation store purchase

Hi Guys

I need some advice around the Consumer Protection Act and how it applies to the Playstation Store. I need to know if I can take any action.

Here's what happened.

A few nights ago I logged into the Playstation Store and browsed to PS+ to see what the free games for the month are. I very occasionally browse them and have never actually downloaded one before as they typically seem to be useless. I noticed Fortnite and it seemed interesting. I clicked on it, watched the video and it basically says "If you're a Playstation Plus member, you can download this exclusive item and keep it forever...." so I thought great I'll give this one a shot. I started the download. I went to sleep and left it to download over night.

The next day my 8 year old son got home from school and turned on the PS, noticing the new game he went in. I was not near him and I had no idea what he clicked on etc as I hadn't even launched the game yet myself, after he played for a bit he went to his classes. I was working and my phone was on silent, i finished what I was doing and I looked at my phone and noticed an SMS saying that R1199.50 was transacted on my Credit card and saw the gmail notification which I went into immediately. I saw that this transaction was for a Fortnite - Limited Edition Founder’s Pack (Game Pack). I got home and immediately deleted the game and went onto Playstation to log a refund request.

The answer I received was as follows:
"Thanks for your email about Founders Pack.

As you might know, the content purchased is additional downloadable content (DLC) which expands the base game experience. In this case, the DLC has been provided for use with Fortnite and was activated when it was downloaded. Because of this, we can't offer a refund on this occasion. For future reference, you'll find details of our cancellation and refund policy at http://bit.ly/PS_Cancellation_Policy...."

My face turned red!!

I replied saying that I cannot accept this, it is unethical and we have a CPA here with 14 days etc.. (I deleted the game around an hour after the transaction went off)

I received another response which then says that I need to get in touch with Epic games and see if they can delete it from my account then PS will refund.
I followed the link they sent to me which directs you to Epic Games. On Epic games site there are no contact details (phone, email, chat) only a support page. On the support page refund on PSN sends you back to PS' website however if you select refund from a purchase on Epic games then there is a refund form which can be filled in. So I filled this in since this is the only method of getting a message to them. I've received nothing, not even an acknowledgment saying that they have received a request.

As with most ordeals, I didn't read the user agreement when I bought the PS, however it turns out that PS really cop out on a lot. This agreement confuses me, simply put, but what annoys me is that they get around their liability by adding a clause saying that the parent/guardian is liable for the cost if a child makes the purchase.

Fine even if I was forced to accept this, my children know very well that they not allowed to click or go into the PS store and they have never done so. The difference is that this was something was clicked on from WITHIN A GAME. to me this is completely deceitful and tantamount to theft.

I've attached a Pic of the PS+ screen as it's still available and prob will be until the end of the month.

CPA will not and does not protect you here. There is no 14 day thing you speak of.

Why do you have your credit card stored on you PlayStation if you don’t want to take responsibility for your child action. And purchases within the game are not deceitful , consider it takes you out of the game to make the actual purchase.

Get familiar with your product, remove the credit card details, and own up to your accountability.

Even if the CPA applied it wouldn't be enforceable internationally. And I don't agree that they are getting around liability here. As a parent you are responsible for what your kid does with your credit card details. Using it means you gave authorisation to do so and there's really no easy way for the PS store to check or to refund people that claim afterwards they didn't authorise a transaction.

any case the only fortnite om ps plus special are these i.e not the free one.

That’s strange cause I know with Apple you can get a refund if you follow some online process. Have you tried contacting Ster Kinekor (Primedia) for assistance cause I think they are responsible for PlayStation in South Africa.

No need to delete credit card.

Just ask it to request your password on a purchase or even better implement the parental controls and give your kid their own account.

Also the PS+ games are frequently quite awesome. You should download them all and be more open minded.

Tldr; it's a failure on your part OP. You can't blame the manufacturer if you left your keys in the car and your kid tried to drive off with it.

There must have been a few steps required to purchase the add on bundle and the kid went though it all in his excitement to play the game
Kids do this all the time hence the parent or guardian is made responsible.

I know Apple allows refunds so not sure about their t’s and c’s

Sony will never refund, you're wasting your time.
I have always kept the "request password to authorize purchases" just in case I myself accidentally click something and get hit with a debit.

Considering the dlc is 50% off, your school fees are at least half of what it could have been.

Try to contact your credit card issuer/band to dispute the purchase. Usually that works in cases of fraud but I'm not sure if they will do a charge back if you claim unauthorised purchase...
Might work.

Doesn't it ask for the CCV number? I know this is something that isn't usually stored and you can't purchase without it.

Xbox doesn’t. Not sure about ps4 but I suspect it doesn’t when the details are stored

Ok I see now. On GoG and other stores it usually asks me for my CCV but with Paypal I just click through. Perhaps what we need is new regulations from CC providers that requires a CCV for all non-recurring transactions.

I don't agree with this, I do not study every platform but here's what I know having used Microsoft, Android, IOS and others with my Credit stored. before any of them are transacted, they require my password or fingerprint by default. PS clearly doesn't.

As for the tone of your message, I'm asking for help, refrain from answering if you feel like you need to be bashful.

My kid has no idea what my CC details are and has no access to it since my card was on me at the time. My CC details are stored on the platform and it clearly was transacted without me authorizing. I'm not the kind of parent who would give an 8 year old my CC details.

Def lesson learn't, I've now found the setting to change it to "request a password"

It's still on the store if you browse from your console and select PS+. But thanks for this screenshot, I'll look into this more as I was charged double the price for the bundle that was downloaded then.
