Anybody clued up on this?

With regards to my previous thread, I bought a Golf tdi, turbo failed 60km from the dealer.

Now Iv been waiting since 20 April, they got back today and say they are only going to replace the impeller.

I am demanding an entire new turbo or the transaction be cancelled.

Can this deal be cancelled?

if by fixing the impeller (whatever that is) will the car be in a working condition ? if so then i dont think you can demand a new turbo.

with regards to the deal being cancelled, it is a while since you bought it and they have offered to fix it, so i dont think you have any recourse there, or atleast it hink

Before 1st April you bought it?

If so then you're out of luck otherwise if after you should be able to take it back and ask for it to either be fixed, exchanged or get you cash back with zero penalties.

Well this where most people would love to hand the vehicle back or cancell the deal.

Problem is even with the CPA the dealer is only obliged to carry out repairs to enable the vehicle to be in working condition due to the vehicle being sold as a "used" vehicle. However i beleive if the vehicle was new, you could demand a new vehicle. Even if this was the case i beleive the CPA would fail if you financed the car. Once you sign for a vehicle on finance you can not get it exchanged or demand a new one. The legal fee's to change your contract from one vehicle to another would be exorbitant.

So in short, the dealer must repair the vehicle to an operational condition or as was promised to you at the time of the sale. If you paid cash for the car i'm sure the dealer could or would make a plan for you if you shouted loud enough.

Ouch that sucks. I wouldn't be happy with a repair. Normally turbos go, they don't leave much room for repairs as far as I have heard.

But maybe they can repair it? I guess as long as they fix it and it is in perfect condition then its ok.

How I understand the process... if it breaks... it needs to be repaired, but if it breaks again (same fault) within a certain time... they need to replace(new part)/refund.
There is a lot of Fine print and T&C on the act.. but that is the simplified version.

I would say, try your luck with the CPA. I'm sure there is still a lot of confusion around this subject. Public is still unsure of what all they are protected from (and the documentation is damn long)

Remember that the CPA doesn't provide any new rights for you. You have always had them. It just makes it a bit easier to sue

We make you sign an 8 page document when buying a car, just so that you are completely sure what you are getting yourself into.

Basically the Dealer must repair the car to your satisfaction.

In theory you could go on returning the car ad infinitum, but try that one in reality and you will come unstuck.

Hi, I hope this thread is still alive and someone reads and responds.

This is my situation: I bought a car from a dealer four weeks ago and it is still under manufacturer's warranty. This passed weekend it suddenly overheats and I have it towed in to manufacturer's garage. They called me today to say there's damage to the radiator and it's been fixed before, but has leaked again which lead to the car overheating. They also say the warranty won't cover the cost to replace it because of that.

Now obviously I'm angry and want the dealer to sort it out, but I want to get my ducks in a row first. I know the CPA has a clause to the effect of However, if any defects are discovered within six months of the date of sale, in accordance with Chapter 2, Section 56 of the CPA, you have the right to insist on repair, replacement or refund for the vehicle (taken from the AA website.) Can I present evidence to him of the damage and insist he pays for the repairs?

You should be OK - hopefully you bought the car from a reputable dealer - if it was from some little "Main Road" dealer, you might be in for a fight - the good thing is that you do have the weight of the CPA behind you. :)

I have a question seen that this has become a free for all.

Bought an A4 2.0T 2 weeks ago, I noticed that when lifting off throttle between 2500rpm and 1500rpm there is a strange buzzing sound (like a card is spokes). It must be boost related, probably a loose wastegate, torn DV or even the CAT rattling.

Regardless, the sound is annoying, I know someone else with the same car whose car has been doing this for the last 8 months already, so technically the car is in running condition, I already phoned the dealership to tell them I am bringing it back for them to sort out which they agreed to, only worry is if it turns out to be expensive I would imagine they will try and get out of it saying the car is running fine (Yes I am a worst case scenario kind of guy).

Where do I stand should they turn around?

Also (smaller notes): The sunroof shade (the cover that slides) does not automatically come back out after completely opening the sunroof, also it rattles a lot (I assume this is related). Are they able to get out of not repairing this?

Is this a big brand dealer?
Then walk in there and state your claim. If they have issues, start making a noise up the ladder....

Main road dealer unfortunately, from speaking to Audi though they sound quite "Prestigious" though and the owner is a hell of a nice guy. I guess I will just have to see how this goes.

Good to know, In my idiocy though I bought the car like this, not something that happened after purchase, I have never used a sunroof before so didn't know the blind was supposed to come back out and never noticed the noise, so hopefully they wont try and pull a "you accepted the car like this" story.

Ok, let me stop being negative and just see what they have to say lol

Dealers are now reserving a certain amount of cash for any repairs within 6 months of selling a used car. Well, the smart ones are, at least.

Guys, why are you buying used cars without warranties?

I have a mechanical warranty on my car, i just don't want it to come out of my warranty if the dealer is the one that should be fixing it.

rather let them do it under the waranty, any costs to be theirs, permitting it won't affect your monthly fees or any other such.

if it breaks again later, warranty cannot refuse to repair it that time around. Else any future repairs on that will be for your pocket, as they will not know who did the then previous work
