Cost of Court (Speeding summons)

Guess it's off to the cop shop then for a cap in hand payment.

Is there still a court requirement now that I have been summonsed/summoned? (sp?)

Or can I still pay fine (admit guilt) and walk away? Don't want to show up there with cash in hand only to be turned away or arrested...

Another question: can they serve a summons at your work address or only your home address?? My flat is pretty secure. Certain no summons will find me there...

They can serve a summons anywhere, usually on the address you used to register the vehicle. I just spoke to a buddy of mine, who "is in the business", and he gave me this example, over and above from what I wrote in the previous post, say they don't find you, should you ever be caught up in a road block, they will then immediately arrest you, put you in the bus, and you will spend the weekend in a MAIN prison, i.e Pretoria Central, if you are arrested in pretoria, but should they arrest you at your home or place of business, you will sleep the weekend in the local police cell, I keep saying weekend, because they like arresting people on Friday afternoon's, because the soonest you can see a judge will be the following work day, iow the Monday - "tap that a$$ weekend show";) - I'm also told that they don't usually impound your vehicle when they catch you in a road block, you have to arrange transportation for the vehicle, iow they just leave it next to the road. - But I'm not too sure on this one.

I'm not too sure if you pay the fine that they will drop the case against you. I was however told that they will charge on 10%+ interest Per Month ("High Monthly Interest")

Should you not be arrested even after all that time, and you go and renew you drivers license, they will then revoke you license, and arrest you, and charge you compound interest for the entire duration.

Okay, * takes a deep breath*, depending on the severity of your fine, they might let you pay and you can walk away, but, they also can arrest you there.... e.g if you drove 140 in a 60 zone, you WILL be arrested, no questions asked, but if it was say 66 in a 60 zone, they should let you go. Generally, the 10% rule applies here as well, not only for speedometers. I can't exactly remember the formula, but if you drive 140+ in a 120 zone, that equals warrant for arrest, 130 or so, is just a fine.


Again, I'm no legal eagle, I'm only passing on information, that I was told - I have several sources. Also, the best advice is to seek professional legal advice. My buddy usually does not speak a load of bull, but I did tell him it's for someone on an internet forum, so I don't know if he added stuff to it to make the law more revered.

You can still pay the fine after the summons - do it online if using FNB/ABSA - or go to the post office - many ways.

A warrant for your arrest cannot be issued until after you've accepted the summons from what I know...

Summons was signed by someone on my behalf...

Eish. Guess I'm just going to have to pay up then. Humble Pie. Yum! :(

Grounds for arrest on the spot is 160km/h in a 120 zone;)
My new stepdad's a bigwig in the metro PD, confirmed it for me.

Court fee's used to be R800 back in 2004, I don't know what they are now.

I went to court once because I was summonsed, in Welkom, I drove all the way from JHB to Welkom to go to court.

When I got there, about 2 hours early, I sat around near the court and watched the chaotic and pathetic proceedings. About 10 case numbers would be called 5 minutes would pass, the ruling would be given, that neither the officer nor the accused are present. Then the judge would say something about the sherrif must do warrants or something.

I got bored, and I found the prosecutor wondering into his office, and asked him if I could speak to him about getting my case moved up, and he nearly killed himself laughing at me.

He said that he has advice for me, and if I like the advice then I must pay him R50 for the advice.
So, I said: Okay.

He said:
1. Court appearance is R800. Whether you win or lose is of little consequence, you're still going to be billed the R800, unless you can get the case struck off the roll.
2. If you pay the fine, even 10 seconds before your case is called, there will be no legitimate reason for you to appear in court, and the case will eventually be struck from the roll.
3. The pay booth is through that door to the left.

I paid him his R50 and went and paid the fine.
Best R50 I ever spent, and the 1 and a half hours spent there was extremely educational.
But, that was back in 2004.

I doubt you'll be held responsible for R80 appearance fee if you are innocent...
