Cyclists could be forced to get number plates and insurance under Highway Code changes (in the UK)

His insurance claims against you. Why should he foot your bill? And you might find yourself paying court costs way above the worth of your scrap cycle when the insurance proves it was your fault.

I would like to see an example of an insurance company that successfully sued a cyclist.

You'll tell the judge to get stuffed?

When you're in an accident you need to go to the police to give a statement. Most of the time it comes down to your word against his.

As I said, unless there is an actual intent to ram into a car I doubt that his insurance company will even get involved.

One day I was driving chapmans peak towards Noordhoek, in my car, doing 40-50km/h round the bends, can't remember exact speeds. There was a cyclist behind me literally riding up my arse trying to overtake (it's not like one can really move over).

Anyways, on the one bend he decides to go for it. As he reaches the drivers window, a car comes around the bend. Dude slammed on breaks and nearly offed himself as he ate sh** on the tarmac.

Fortunately no injuries or damage to anyone but I still get a good chuckle thinking about it

Depends on the costs. Hit a Ferrari and cause R100 000 damage and you can bet the insurance company will see you in court.

I would laugh if that occurs on my R300 bike on route to the shopping mall that is 2km away. Maybe I should get the lawyer to countersue him for the trauma.

That's because the traffic police in SA are useless.
Wasn't really the point. The point is rather that you can't insure or license away problems.

While insurance may be required in our modern society for big ticket items, basically the world became dependent on this reverse lottery system, but somewhere you'll have to draw the line. Otherwise you'll end up needing insurance & licenses for every activity that could potentially result in an accident.

Such an overbearing bureaucratic nanny state should never be desired.

Scarborough near misty cliffs. Small peleton of arrogant cyclists taking up the entire left lane. Bakkie with two guys on the back decides to take action. They pull up to the last guy. One guy on the back grabs him and the other klaps him off his bike. Continue right to the front. Nobody in the queue of cars stopped to help.

Sure. Engage a lawyer for R30k to fight an insurance company with deep pockets that will keep delaying the case to ruin you financially and then still sue you for the damages and legal costs.

You're obviously young and have no clue about litigation.

It is what differentiates 1st world from 3rd world.
The thought of why should your actions mean I need to suffer in any manner or form

The mentality in SA is pure 3rd world. If I can get away from it I will. I know of 1st world countries where if a automated payment system is offline , people pile coins on the machine , because it is teh honest and fair way to do things. And that money wont get stolen

Ask a litigation lawyer about your scenario next time, he will laugh.

Not really.. For example look up "The Moral Hazard Argument" and how it relates to insurance.

Also not accurate. For example NY has a massive problem with subway fare dodging. Is that a third world country?
3rd world countries have a bigger interplay between integrity and survival.
