Judge Rules Jury Can Consider Castle Doctrine In Amber Guyger Murder Trial

Guyger, 31, killed her upstairs neighbor Botham Jean the night of Sept. 6, 2018, in his southside apartment. When she took the stand Friday, Guyger told jurors through tears how she mistook the 26-year-old accountant’s apartment for her own and believed Jean to be a burglar.

After abbreviated testimony on Saturday, defense attorneys rested their case first thing Monday morning. During a session, outside of the presence of the jury, defense attorneys and prosecutors argued over the language of the instructions the judge with provide to jurors. It was during this session that Judge Tammy Kemp ruled the jury can consider the Castle Doctrine during deliberations.

The Castle Doctrine, similar to the Stand Your Ground Law, allows a person to use “or using force (even deadly force) in the protection of a home, vehicle, or other property if someone attempts to forcibly enter or remove an individual from the premises.

My family, including my brothers when they were still children, managed to keep calm and listen to the commands of a bunch of home invaders pointing guns at them.

If you think I am defending this woman, I am not. She should get charged with murder. As everyone here is pointing out, her defense is. B.S.

Nevertheless it stands as a separate point that if someone is pointing a gun at you, it is a pretty good survival strategy to do what they say.
I understand what you are saying but think it's very dangerous to have a pre-conceived idea of what you are going to do for every given situation.

Each situation is different and has multiple factors that can change every few seconds.
I would assess my actions/options constantly as to maximize the chances to keep my loved ones and myself alive.

Not to mention that we have seen more than a few shootings when cops have given vague or contradictory orders to suspects. If this woman made such a basic mistake as to go into the wrong apartment what likliehood is there that her orders where clear or logical or that the victim was in any position to obey her (he could have been asleep on his couch for all we know...)

– A jury in Dallas has reached a decision in the Amber Guyger trial. They found the 31-year-old guilty of murder for the death of Botham Shem Jean.

Around 10:30 a.m. more than half a dozen law enforcement officers filed into the courtroom, in anticipation of the verdict.

Guyger was on trial for the 2018 shooting death of Jean, her neighbor, who she shoot in his own apartment. From her initial call to 911 and throughout the trial Guyger claimed she thought she had entered her own apartment and that she opened fire on Jean thinking he was a burglar.

And she's allowed out on bail until sentencing. Talk about a ***** pass.

On 24 November 2017, a South African court increased Pistorius' jail sentence to 13 years and five months. Prosecutors had argued that the six-year term was too short. The SCA ruled his sentence be increased to 15 years, less time already served.[194]

On 19 December 2017, it was confirmed that Pistorius had filed papers with the Constitutional Court to appeal the newly increased sentence and have his previous six-year sentence reinstated.[195] On 9 April 2018, it was confirmed that on 28 March 2018 the appeal was dismissed by the courts;[196] Pistorius will not be eligible for parole until at least 2023.[197]

Oh yeah I forgot. I remember his sentence was increased. But still, at first they thought 6 years would be enough
