Cape Town - Should the Equality Court rule in favour of a transgender prisoner to express her gender identity as a female in a male facility, then the Standing Order in prison should be sent back to the minister for review.

Tuesday marked day two of arguments in the Western Cape High Court, sitting as the Equality Court, with transgender prisoner Jade September challenging authorities and accusing prison heads of discriminating against her by not allowing her to wear her hair long, wearing make-up and jewellery or female underwear.

September is serving 15 years for killing a client in May 2013.

While incarcerated at the Helderstroom Maximum Correctional Centre, in Caledon, September said she was subjected to verbal abuse and harassment from prison officials, and at one stage placed in segregated confinement for 17 days in 2016.

This was after she defied officials and expressed her gender. Her personal items were confiscated, and she was forced to cut off her braided hair.

September’s legal counsel, advocate Nicole Lewis argued one did not need to undergo surgical transition to be defined as transgender. It had to do with gender identification.

Not sure what the hoo ha is. He identifies as female. Put him in a female prison. Same with all the other males who identify as female :cool:

Then build specific trans prisons. Why should the other gender be treated any different?

If we really want to work towards equity we should be building unisex prisons :cool:
For heavens sake, just make sure they have TVs then! You know what happens otherwise ... we don't need another population explosion. ;)

This is not a female.

This is a male. As well as a murderer.

He belongs in a correctional facility for males.

It's that simple.

His mental problems are his alone and should not be foisted onto anyone else.
They did that in the UK, did not work out so well for them.

Where does it say she wants to be transferred to a female prison? I didn't see that bit...

Agreed - the headline is misleading af.

In fact, September's lawyer said:

Placing September in a woman's prison may not be the solution to the issue, Bornman said.

"The first questions are always, 'why is she not simply transferred to a women's prison?', and 'is it not dangerous for her to look like a woman in a men's facility?'" she said.

"The truth is, because Ms September has never had access to gender-affirming healthcare, she is likely to stand out even more, and be at greater risk of victimisation and violence in a woman's prison."

with which I agree - we South African females can be savage.

Court victory for transgender prisoners

The Equality Court has ruled that a woman transgender inmate may express her gender identity while incarcerated in an all-male prison. The court ruled, on 23 September, that the inmate is allowed to wear her hair long; wear make-up; wear female clothing and be addressed by officials using female pronouns.


Background

Jade September is a transgender woman who was convicted of murder and theft in 2013 by the Cape Town Regional Court. She was sentenced to 15 years.

“Transgender” refers to a person whose gender identity differs from their sex assigned at birth.

At the time of her incarceration, September’s Identity Document (ID) indicated that she was male. She has been serving her sentence in all-male prisons.

September was first imprisoned at Pollsmoor. Then she was transferred to Helderstroom Correctional Centre. She was allowed to express her gender identity by wearing braids and being addressed as a woman.
But when she was temporarily transferred to Brandvlei Correctional Centre her make-up and female underwear were confiscated.

When she returned to Helderstroom she had an altercation with the head of the prison. According to September when she informed him that she intended to transition he resisted, saying that he “would not have” her “looking like a woman” because she is a man.

September alleged that after this altercation she was segregated from other inmates and placed in solitary confinement for a period of 17 days. She was forced to cut her hair and sign a warning stating that if she committed anymore infractions (such as wearing make-up) she would renounce her Group A status. This status is conferred to prisoners who are considered to have good behaviour.
