Debt collectors harassment

Good day all...
I have an issue with debt collectors contacting me for an account I've been making payments for. I was dealing with game directly in February and now attorneys have started calling.They also now trying to increase the monthly amount I have to pay. I'm already paying R1050per month and was only behind 5 payments (payment I'm now paying is double the monthly installments previously)
I have request a statement and all contact to be made by email going forward as in February 2018 I had already made a verbal agreement regarding the account being behind.

First off you should have ignored the attorneys as well as told them you are paying game directly as that is who the agreement was with, Secondly paying more is a tactic used by attorneys, as they may not refuse a reasonable payment agreement, or any amount above your means or negatively affects other creditors.

If you verbally agree to repay R500 a month extra or what ever the case might be, it is fixed for the repayment period or the agreement, if they contact for more money and you agree then the terms is updates, but otherwise the term is fixed if they agree to the terms or the repayment agreement, they can't turn around and say they want more money now or else, as they agreed to the repayment terms as that may put you in a compromising position, essentially they are phoning daily to wear you down to, with threats or harassment to agree to their terms.

Secondly you have the right to dictate means of communication, email is good which means you have every thing in writing, additionally if they still contact via other means of communication, inform then on which and which date you set the means of communication, failure to adhere is seen as harassment and will be taking the matter further with the ombudsman.

Unfortunately your agreement is now with the attorneys, and they will be adding on the interests and "fees" like they are going out of business.Do not agree to further payments increases, as they agreed to the current payment plan, which is now fixed unless you change, manually do payments via EFT, regardless if they offer cheaper rates for doing it via debit order, there is nothing stopping them doing additional debits.

Good luck keep calm and tell them your means of communication is email and they should revert to that medium, and cut the call short.

Sounds like the OP had an arrangement direct with Game but then skipped some payments and that is why its gone to lawyers/debt collectors.

But how do I have agreement with the attorney's? As they only called yesterday and made no agreement with them to pay anything... Agreement made in February with game the creditor... Also they claim I'm still behind on 5 payments
Of R489 even though I have made 2 payments of R1050 since agreement was made, the agreement was that game wouldn't hand me over to attorneys and I could get game card back after 3 payments of which I've made 2 payments... I've also ask twice that communication to be done via email only and requested twice for statement/loan agreement and then stopped hearing from them for today anyway

Yes I did miss 5 payments but had spoken to game and made agreement to pay. Which was in February made payment in February and march next payment due end April so why the lawyers?

Yeah that would pretty much get passed on to the lawyers.Note this is pre legal still I hope, you can't afford to miss any payment now, if you missed 5 payments, then you need to have a look at your budget, and look what is the most affordable payment you can make.

Inform the lawyer in writing that you can afford to give them so much a month, until the debt is settle, but also mention if and when possible you will make additional payments.If you miss a payment now, they have no further obligation to assist or give any leeway.

These people routinely mess up their own admin. You should still get your regular statement. Just honour your original agreement and pay as you should. Then check that your balance is correct on your normal statements that you get.
Ignore the attorneys, tell them to get lost and that you have an agreement with game not them.
Don't take the game card back. The fees and interest on that RCS cards are stupid high. Don't make life difficult for yourself. If you now have R1000 to pay monthly you can get whatever you need from game cash in a few months after you settled your debt. And if you really want that new tv rather get a propper credit card from a real bank not the RCS loan sharks.

Tell the attorneys to fark off! You already made a arrangement with Game who your contract is with. END OF STORY!

Just stick to the payment arrangement until its paid off or you up to date with the account.

when you say, you spoke to game, was it their accounts department or someone at the store?

You brought up a good point to mention... Unfortunately I've never reserved any statement from game... Someone adviced me to ask these lawyers for it plus supporting documents. I've now waited 5days for them to respond and I've emailed game to find out what's going on?

So yesterday I got SMS that made it seem RCS didn't get payment I made at game store on the 1st. So I called to tell them I have done payment to game as per agreement with game.. They continued falsely representing themselves as RCS employees and said they will email me I must email proof of payment but then they started talking about pushing payment up to R1520 per month I told them no I will not pay that as I'm already paying more than double the original monthly payments which was R475 per month... Luckily for me I have witness to the hole phone call. Well anyway when I opened my email I see its still only the debt collector from Blake's ass so I sent them a straight forward email back saying I have no agreement with any 3rd party they must send me a letter from their client refusing payment of R1050 per month or stop harassing me... They welcome to take me to court hopefully now they will leave me alone... I've been adviced if they contact me again I must send them a letter of demand for refusing payment

This is worrying. You should get your statement from RCS or game and you should use that to control how much you still owe and have to pay each month.

And it took over an hour to get this 7cm slip I'm on call 24/7 with my job so I really don't have the time to go through that every month I just use clear score to keep an eye on everything

That is not on...

If Game are providing credit (even through RCS) they must legally be able to provide you with a statement.

I know but I just don't have the time to go make big deal about it and when my wife goes they won't help her whatsoever. I mean in it took over an hour to get 7cm slip I don't know how I'll be able to wait around for a A4 size invoice as I've mentioned I'm on 24/7 emergency call with my job
