Racial discrimination IS legal.... in the form of Affirmative Action. It's actually written into the Constitution. Did you just realise that?
It redresses the wrongs of Apartheid.
Actually it does not. AA and BEE and the bunch of other letters have only helped to enrich the connected criminals and their pet politicians. The non-connected people of colour are being taken for a ride in a broken down buggy, while the gravy train is running laps around them. Unfortunately, they are just too thick to realise this...

Putting a blanket ban on hiring someone when their CV states they are 'white' is unfair discrimination and unconstitutional. Yes it's complicated but we shouldn't lose sight of the biggest problem with the 'fair discrimination' policy - there's no moratorium/sunset clause for a policy that seeks to redress the wrongs of apartheid!

You and I know that as the net effect and the real outcome... but it doesn't change the intended effect of the original legislation.
There is nothing wrong with Affirmative Action as a laudable ideal.
Just because the ANC cocked it up doesn't mean it's wrong in it's ideals.

That's why I said from the start that is was a problem of Dischem hiring proper Social Media managers....
They knew what they INTENDED to say.... they just didn't say it right.

It redresses the wrongs of Apartheid.

So two wrongs make a right then? When do the wrongs of post apartheid get addressed? We can go on like this forever. And why do you need to protect 91% of the population from 9%?

Post 1994, according to the CODESA negotiations, there would be no racism whatsoever. The ANC reneged on this and wrote it into the constitution in 1996. So it's illegal as it was not agreed upon at CODESA.

What are the ideals of affirmative action?

AA was brought up at CODESA, but it was agreed upon how it would be enforced.

Of course it's wrong in its ideals. It unfairly disadvantages a specific race from equal employment opportunities and is therefore by definition institutionalised racism. Unless you think being racist against one particular group is not wrong.

This is also the reasoning of Communists/Socialists.

I would have given it about two decades to accomplish it's goals, and then shelved it.
It really didn't need to go on longer than that.
20 years is one generation of workers coming through the workforce.
I can't imagine that it would take longer than that to redress Apartheid.
Anything longer than that would be an admission that the ANC really screwed something up in the economy.
