I understand the biological parents have been grieving for a long time, my only concern now would be what is best for the child in question.
She has a mother and father who she loves, who have brought her up as their own. She loves them and wants to remain with them, even knowing the truth. Now her mother is going to go to jail and she has 2 strangers who want her back as their child. It's very sad and I hope they are lenient on the mother for the sake of the child.

I don't think it's fake love. You don't raise a child for 18 years on fake love

It was obvious that this is how it would turn out. They can have some closure that they know their daughter is alive and well. That she was not killed or abused. But anything more than that was hardly ever on the cards. At most, the younger sister will have an adult friendship with her.

I feel terrible for the parents. The kidnapping might even be the main underlying reason as to why they got divorced in the first place. And why the MiL has such a strained relationship with the bio-dad.

The amount of damage this woman caused by stealing an infant is immeasurable. 10 years is too short.

'Nobody wins in this case' - Celeste Nurse

Cape Town – A woman may have been convicted of snatching newborn Zephany Nurse many years ago, but nobody wins at the end of the day, her biological mother told Heart FM this week.

“In a certain way I think justice has prevailed, but like I mentioned before, for me it hasn’t done anything because I have still lost the years with my daughter,” Celeste Nurse told host Aden Thomas in an emotional conversation broadcast on Tuesday morning.

“There is no special bond between the two of us, so for me it’s like it’s all for nothing.”

The Western Cape High Court last week convicted a 51-year-old woman of kidnapping, fraud, and contravening the Children’s Act. She was expected to be sentenced at the end of May.

In a soft voice, the mother said there were no winners in a case like this.

“Everybody loses. So nobody is happy at the end of this whole situation. Everybody is heartbroken. There is emotion. It is actually like the 18 years is starting now.”

She felt things would have been different if the woman had come clean and revealed what happened all those years ago.

“But I do feel sorry for her because what she is facing now, she doesn’t know what is awaiting her.”

They had heard the woman had a history of miscarriages and abuse in previous relationships.

“So for me to judge her, I have got no right to do that. I don’t know what this woman has been through, how her life has been.”

She told Thomas it would be enough if the woman opened up to her. At the moment, she did not have closure and felt incomplete.

She had waited 17 years, and would wait at least 10 years more, for a proper relationship with Zephany Nurse.

“It could be the next 15 years or the day when she starts having a family, but I will wait as long as it takes. I am not going to push my daughter. I am going to wait up until she decides to come and say: 'Mommy, I am ready. How are we going to go from here?'"

May have been worse if they found her when she was 14/15 and the court may have ordered her to live with her real family and she may have not wanted to

#ZephanyNurse mom extends olive branch to kidnapper

Cape Town - Celeste Nurse would visit the woman who stole her newborn baby in prison, if it came to that.

In an interview on Heart FM with breakfast show host Aden Thomas, Nurse said she had compassion for her child’s kidnapper.

“I do feel very much broken-hearted for her and would like to visit her one day and to ask her the question: Why?”

Nurse said although there was no bond between her and her estranged daughter, she still felt sorry for the woman who had denied her a relationship with her child.

“I feel sorry for her… she has had miscarriages before and she has been abused in previous relationships.

“For me to judge her, I have got no right. I don’t know what this woman has been through, how her life has been.”

Nurse said if and when she had the opportunity to meet with the woman she would expect full disclosure.

“I want her to be honest with me, to tell me the truth that this and that is what happened, so that I can build my relationship with my daughter.”

Nurse said she would be patient in building a relationship with her first born.

“I waited 17 years, I can wait another 10 years.”

Nurse said it was comforting to know that her daughter had been well taken care of over the years and that she felt safe with a man she grew up thinking was her father.

18 Years based on lies and deceit, is not love.

Of course it is. How it started does not invalidate the mutual love. This woman is not a monster 100% of the time, pretending to love those around her. She is a woman who had some kind of mental breakdown and turned into a monster for a very brief time in her life. By the time the mental wounds healed, she was in too deep and there was no other way but forward.

Zephany Nurse to testify in camera for the State

Cape Town - Teenager Zephany Nurse will testify for the State in the sentencing proceedings against the woman who kidnapped her when she was a newborn baby and raised her.

Western Cape High Court Judge John Hlophe ruled on Monday that the testimony would be heard in camera. Only the officers of the court would be allowed to be present.

Prosecutor Evadne Kortje said the State was ready to proceed, and that reports from the accused’s probation officer and victim impact reports for biological parents Celeste and Morne Nurse as well as Zephany, 19, had been obtained.

However Riaz Khan, for the accused, said he had only received the judgment, which was delivered in March, on Monday morning.

Hlophe postponed the matter to August 1.

On March 10, Hlophe convicted her of kidnapping, fraud and contravening the Children’s Act. She had insisted in her testimony that she had not been at Groote Schuur Hospital on the day Nurse was kidnapped in 1997.

The woman was arrested in February 2015. The matter came to light when the girl's biological sister, who is four years younger, told her parents a matric girl at her school bore a striking resemblance to her and her parents.

According to her testimony, she got the baby from a woman called Sylvia, who had been giving her fertility treatment in 1997 after she had miscarried.

Sylvia allegedly arranged for the baby to be handed to her at the Wynberg train station without her prior knowledge. The accused claimed to have been surprised because she had expected to meet to discuss the adoption process.

Sylvia claimed she knew of a woman who did not want to keep her baby because the pregnancy was unplanned.

The accused testified the woman said the paperwork would be arranged later and she had signed documents including an “adoption application”. She claimed to have never heard from Sylvia again.

The accused said that six years later, she received a birth certificate by post with the name she chose for the baby.

Hlophe in March said he had “listened to her lies for days”.

Morne Nurse, Zephany’s biological father, previously testified he collected evidence for a month after he met the teenager, after his daughter and the girl became friends.

After collecting his daughter Cassidy and the then 17-year-old from school in January 2015, he took the two friends to lunch, where she told him her date of birth – April 30, 1997. This was the date his daughter was abducted.

When he told her she did not look like her parents and looked just like him and his daughter, she burst out laughing.

He backed off as he did not want to scare her, but "scrutinised" her Facebook account and printed photos of her growing up.

Nurse said he sent a photo of the girl and her mother to witness Shireen Piet. Piet had testified that she had seen the woman in the hospital on the day Zephany was snatched from her sleeping mother.

When he asked Piet if she recognised the woman, Piet said she did.

DNA tests later confirmed the teenager was Zephany.

When they say, "Zephany Nurse will testify for the State", does that just mean that the State is calling her as a witness? It doesn't necessarily mean she will be giving evidence in support of the State's case? Although why would they call her as witness then... am I answering my own question?

War of words between kidnapper's family and Zephany's biological parents

Cape Town - A war of words broke out on the steps of the Western Cape High Court on Monday between Zephany Nurse’s biological family and loved ones of the woman accused of snatching her in 1997.

The kidnapper’s supporters hurled harsh words at the Nurses and their friends, shouting that it was their fault the teenager no longer wanted to have a relationship with them.

A relative said while the people who raised Zephany - who now goes by the name given to her by her kidnapper - have been encouraging her to bond with her biological family, the 19-year-old refuses.

“If they come to the house, she doesn’t want to speak to them. She was hurt by how they belittled the people who raised her, during the trial. They are the only parents she knows,” the woman said.

“That man who the Nurses called an idiot is the one who she loves the most. He loves her so much. He supports her financially and in every other way. He gets up every day to go to work to provide for her. What has her biological family done since they found her?”

‘It’s clear who she wants to be with’

Following the kidnapper’s conviction, the Nurses had put an enormous amount of pressure on Zephany to choose between the families, the woman claimed.

“It is clear to see who she wants to be with. And it’s because of their persistence and unwillingness to think about how she feels that is driving her away. She even changed her number because she was being bombarded with messages where they force themselves on her. She doesn’t need that.”

The woman’s husband told News24 his wife is doing well and “is surviving” behind bars.

He refuted claims that she had been assaulted at Pollsmoor Prison, saying she had not seen any trouble since being locked up.

New hairstyle

In the dock, the kidnapper sported a new, sleek hairstyle which did not sit well with loved ones of Zephany’s biological parents.

“Waar dink sy gaan sy? [Where does she think she’s going?],” one woman asked after proceedings.

“Lyk die tronk doen haar goed [Looks like jail is treating her well].”

The woman’s sister insisted the family had stood by her, and visited her twice a week.

“There’s no way we will just leave her there. They want to see her in jail, but God knows best. She raised me, and was a mother in a million for Zephany.”

After Judge John Hlophe postponed the matter to August 1, the Nurses and their relatives prayed on the court steps, calling for children to be protected from “evil”.

Nurses unhappy with another court delay

Biological father Morne Nurse said the family was disappointed at the delay.

“It’s three months later now and we have to wait another two months. We are not too happy with the proceedings at this stage,” he said.

“We can’t handle it anymore. We’re tired. We just want to have our lives to ourselves. And that is just not happening.

“The world can’t blame us for what this lady is going through. She is in the hands of the courts and the law. There is no remorse from our side - she made her bed, now she must lie in it.”

His brother, Gavin, said Zephany’s well-being was their main concern.

“We must remember at the centre of this entire scenario we have a young girl who is the key figure. She is the most important thing to us as the family and should be to everyone else.”

The 51-year-old kidnapper was convicted in March of stealing the 3-day-old Zephany while her mother slept in the maternity ward of Groote Schuur Hospital on April 30, 1997.

She registered Zephany as her biological child at the Malmesbury home affairs office, and lied to both her husband and the girl that she had given birth to her.

Hlophe, delivering his verdict, said there was overwhelming evidence against the woman, who had suffered a miscarriage four months before the kidnapping.

the biological parents are driving her further and further away from them. i can imagine that they must feel anger etc, but they have to realise that they have not been a part of her life for 19 years and this girl will defend her "mother" no matter what. and from what i am reading the biological parents haven't even made any contribution towards her well being. that doesn't sit very well with people.

Zephany Nurse's kidnapper believes she is the real victim, court told

Cape Town - The woman convicted of kidnapping Zephany Nurse from Groote Schuur Hospital 19 years ago feels she is the primary victim in the case, the Western Cape High Court heard on Monday.

The kidnapper, who may not be named as it may lead to the victim being identified, believes she was unfairly and wrongly convicted, clinical psychologist Mark Steyn testified during sentencing proceedings.

He had met with the Steenberg woman on 13 occasions to assess her mental and psychological health.

"[The accused] was of the opinion that she had not committed an offence," he testified.

"She could not accept her conviction and feels she was guilty of raising her, but not stealing her."

The woman - who described herself as a "mother by nature" - held the view that she was not guilty of causing harm to any person, Steyn said.

She had suffered three miscarriages before the baby was kidnapped from the hospital.

"She maintained she had loved and been a good mother to [Zephany]."

He said the accused presented signs of self-esteem issues, and sought affirmation from others, which may indicate why she appeared to not show any guilt or remorse.

"Admitting to have done something wrong is for her too threatening," Steyn testified.

'Should we feel sorry for her?'

The accused raised Zephany, as well as her sister’s son Gerald, who described the accused as a good, caring and committed mother.

Steyn was the only witness called by the defence to testify.

Prosecutor Evadne Kortje questioned Steyn’s experience, as he had only been practicing for a year and a half.

Steyn conceded that he had never testified in a "matter like this before".

Kortje took exception to the fact that, in the majority of his report, Steyn referred to the victim by the name given to her by her kidnapper, and not as Zephany Nurse.

Kortje insisted that any statements from the accused should not be believed, referring to the woman’s description of her life, as told to the psychologist.

The kidnapper previously told the court that she and her siblings had been deserted by their mother as children, that she had been abused in the past, and suffered from infertility.

"She is trying to make it appear she had been a victim from infancy," Kortje argued.

"She described herself as a loner. So? Should we feel sorry for her?"

The State further slammed the psychologist’s report as it did not give details of what may have motivated the crime or the risk of her reoffending.

"Where is the psychology of the accused?" she asked. "She manipulates people. Where is this in your report?"

Steyn replied he had followed his brief and that this was what had been compiled in his report.

'Listened to her lies'

Zephany Nurse to take stand in court

Cape Town - Zephany Nurse is expected to take the stand in court today (Monday), where sentencing of the woman who was found guilty of kidnapping her is set to begin.

The 51-year-old Seawinds resident is due in the Western Cape High Court, where the defence will argue for a lesser sentence.

Sentencing proceedings were meant to get under way in May, but the woman’s lawyer Reaz Khan said he needed more time to prepare.

At her last appearance, it was also confirmed in court that Zephany would testify on behalf of the state. However the 19-year-old’s testimony will take place behind closed doors after the state applied to have the media barred from proceedings.

Khan has not revealed his witness list but said he would call three people to the stand.

He initially wanted to call Zephany as well, before learning that she would be testifying against the woman who has raised her.

"You have killed us in more than one way," Morne Nurse told the kidnapper while testifying in sentencing proceedings in the Western Cape High Court on Tuesday.

"You will never know what we have been through. Come clean and put your love for Zephany to the test. Tell us what you did, then the forgiveness will come."

The kidnapper, who raised the teen for 18 years, has maintained that she did not kidnap the then 3-day-old infant from Groote Schuur Hospital in 1997.

'Our relationship died'

DNA tests confirmed the teenager was Zephany.

An emotional Morne told the court he did not have a relationship with his daughter.

He claimed that their bond was broken after the woman was released on bail following her arrest last year.

"My relationship with my daughter went dormant – completely cold," he said.

"After the accused got bail everything changed. I felt like my daughter was indoctrinated to a degree. Our relationship died after [the kidnapper] came out. I would love to have one with her, but unfortunately that is just not happening."

When the family was reconciled with their long-lost daughter, their relationship was "brilliant", Morne told the court.

'She would choose them'

He claimed that, despite the woman’s bail conditions including that she should not have contact with Zephany, the woman had lived in the same house as her husband.

Zephany currently lives with the man who raised her and the two share a close bond.

"[The State gave Zephany] the option of going back. She wouldn’t choose us because she doesn’t know us. She would choose them."

Morne said he didn’t have a problem with the relationship Zephany had with the man she believed to be her father for 18 years.

"[He] is the only person she knew [as her father] all her life. I can do nothing to change that."

He declined to answer if he felt his biological daughter had been raised well.

The matter resumes on Thursday.
