The law OUGHT to provide for what I am saying. The officer would then be acting within his legal mandate. As I have said before in this thread.

Spend some time reading the previous stuff please.

I have and your example of discretion is problematic which is why granting such discretion is problematic.

Yeah everyone avoids extremely drunk people, you can be annoying even if you feel you don't bother anyone. That oke sitting there by himself sulking or the one who has nothing to say the whole time, that's annoying.

I'm a bit of an introvert, and avoid crowded areas whenever I can. I drag myself to parties and bars when invited, but it saps so much of my energy...
Interesting, you can buy liquer but not allowed to drink and drive, you can buy fast car, but not allowed to speed, whats going on here really-?

Would you fly a certain routes frequently if you knew airlines flying that route have lax controls on safety and alcohol consumption? There's alcohol on planes but pilots aren't allowed to drink it.

7 days in jail for drunk driving - South African law will not allow this

The Road Traffic Management Corporation (RTMC)'s plans to force drunk drivers to spend seven days in jail are absurd, according to Justice Project South Africa (JPSA).

The RTMC is pushing for tougher action against drunk drivers ahead of the festive season, and proposed to have drunk driving, speeding, and reckless and negligent driving reclassified in terms of the Criminal Procedures Act.

What is? The fact that we keep pointing out to you that corruption is rife and it's not unreasonable to assume innocent people will be affected by it?

Nobody said you can't have any, I have a limit of one glass of light beer if I know I'll still be driving. It's really not that difficult.
Read the comments again. Quite a few saying you shouldn't be drinking and driving.

The RTMC are the official body that runs the NTP (National Traffic Police) so yes, it would cost them money (and us as taxpayers)...
How does that work exactly? I know the TRMC sometimes hold roadblocks on our highways but the metro cops and regular cops are supposed to fall under provincial government. I haven't seen traffic cops in like ages.

The fact that you'd even mention common sense. Laws are not made on presumption that someone entrusted with applying them may be corrupt. If this passes constitutional scrutiny, make it law. Drunk driving is a scourge that must be rooted out.

I'm not apologetic about my stance on drunk drivers. Very irrational people.

Yes they are. That's why we abolished apartheid detention without charges. There's a myriad of laws which law enforcement has to abide by because it's presumed they won't do so on their own. I can also tell you right now it won't pass constitutionality so it's likely just a brainfart for the coming holidays.

So very limited then. Most drunk (and accused) drivers will be in the suburbs.

Not going to happen , imagine the chaos this will cause with prison cells being overcrowded.

You really think overcrowding is something anybody cares about as its already happening??
