As I said earlier... "That said while these new proposal are unnecessarily harsh the current penalties are laughable."

If you go out, knowing the risks involved, and choose to ignore the law then that's your own fault.

I was almost hit by a drunk driver on Friday night. He just swerved from his lane straight into mine I had to brake so hard the ABS came on.

He then carried on driving down the double-lane road straddling lanes and bouncing off the pavements everytime the car struck it between straddling left and right.

I have 0 faith in anything being done about him though because the cops will just stop him and drive him to an ATM for their "bonus".

I think the concern is more the case of the cop being strict over one drink, or deciding you smell like alcohol and putting you in jail for 7 days rather than the obvious case of being over the limit.

Tho I'm not sure how much leeway a cop has in deciding whether to lock you up.

Legally one could drink until you hit the limit right?
What if the officer doesn't have a breathalyzer on him but he says he smells alcohol? He then locks you up. While this might be unlawful, what are you going to do? Resist arrest? You'll only be able to deal with this post 7 days. That's nuts.
"what if"..."might be"....bla bla bla.

Don't drink and drive. Couldn't be simpler.

Apparently these are the risks that some people want to take and also demand that they get away with it when they get caught.

Instead of adjusting their own behavior, they wish the laws to be adjusted to their requirements.

Currently, as I understand it, they need to first breathalyse you then follow that up with a blood test before you can be charged for DUI.

Why not just think for yourself? If you plan to drink any alcohol whatsoever, make alternate arrangements for transport.

I'm confused as to why this is such an issue?

lawmakers. who else? although as a child when i looked up "they", it said "men". but within this context, lawmakers.

currently they allow us to drink a bit then drive

Then don't go drink alone. Take a few friends and one person is the designated driver. The government isn't going to just shut down all bars because a few people can't make alternate plans. For a lot of people uber or taxis or designated drivers is a viable option.

The Road Traffic Management Corporation (RTMC) wants drunk drivers to spend at least 7 days in jail before they can be considered for bail.

The RTMC was established for co-operative and coordinated strategic planning, regulation, facilitation and law enforcement in respect of road traffic matters.

jail corrupted officials for at least 10 years before they can be considered for court.

make sense?

The RTMC is bullshi**ing people. This does not only count for drunk driving, it counts for any offence you are arrested for. The State can ask for a 7 day postponement in order to prepare for a bail application. They normally do this when it is a serious offence and they need to verify a person's identity or confirm addresses and information for purposes of bail.

If you cooperate and provide all your information, they will never get a 7-day postponement in the case of drunk driving.

Reading some of the comments that this is harsh. Nah not really. The world needs to stop trying to normalise bullshit. If you going to drink, use Uber. Don't get behind the wheel because the intoxication levels have you feeling like you've gained some sort of super powers. Maybe the problem isn't drunk driving, maybe people use alcohol as an escape from the reality they live but hey who knows. I'm not an alcoholic.

for a lot of other people it may not be. uber or alternate transport is not an option everywhere.

confiscate their license and/or vehicle,

7 days in our prison cause your blood alcohol level is unusual, metabolism a bit down the day, or maybe from slight dehydration from a race yesterday or you might be coming down with the flu. the reason doesnt matter, you can only explain yourself in 7 days. , many things that influence our blood alcohol level, it doesnt mean we are wasted or incapacitated or literally hitler

At the end of the day, alcohol impairs your ability to operate machinery. Just don't drink and drive - the chances of having an accident or killing people increase exponentially as you get more drunk. That being said, if you are drunk and need to go somewhere, call an Uber or take along a designated driver.

Your attempt at sarcasm does not make any difference to me.

Since you are so mature and a grownup, why can you seemingly not think for yourself?

Either drive OR drink.

If you do both, you are looking for trouble and should face the consequences, regardless of your hurt feelings about it.

So what if the officer just suspects you of drinking and driving even if you haven't? 7 days in jail?

It's not like blood tests are quick. Will they be using evidentiary breath analysers? (the roadside machine are not enough).
Exactly my thoughts also. Some blood tests just disappear or are contaminated. Many charges were also withdrawn due to blood levels within the limits.
The law states innocent until proven guilty.
