Outrage over ex-principal R5m fraud charge

Durban - The Glenwood High School governing body is expected to meet on Monday night to discuss the R5 million fraud charge against its former headmaster, Trevor Kershaw.

Governing body chairman, Robert Young, told the Daily News on Sunday that the meeting would be a closed session.

Young said a new school governing body had been installed three weeks ago and it was the previous school governing body that uncovered the alleged fraud after a forensic investigation.

Stunned parents and old boys have reacted with dismay at the news of Kershaw’s alleged fraud, being investigated by the Durban Commercial Crimes Unit.

Some took to Facebook, saying Kershaw’s 16-year legacy at the school had been tainted by the allegations.

Trevor Kershaw appears to have done quite a bit of travelling...

Skiing in Europe, Australian and Dubai vacation trips just in the past two years - so good luck to the folks trying to get him to pay back the money!

Headmaster ‘interfered’ with fraud probe

Durban - The former Glenwood High School headmaster charged with R5 million fraud may have interfered with the State’s investigation, it was alleged in the Durban Commercial Crime Court on Thursday.

Prosecutor Wendy O’Brien told the magistrate, Judy Naidoo, that Trevor Kershaw may have broken one of his bail conditions and may have affected the State’s case by speaking to State witnesses.

When he first appeared in court in April, he was granted R100 000 bail with strict conditions that included reporting to the Westville police station twice a week; that he not enter the school, or speak to the staff or members of the school governing body; and that he hand over his UK and SA passports to authorities.

Trial date set for Glenwood fraud principal

Durban - Former Glenwood High School principal, Trevor Kershaw, is expected to stand trial next year for allegedly defrauding, alternatively stealing from, the school.

Kershaw appeared briefly in the Durban Commercial Crime Court on Wednesday, where the court heard his attorney, Carl van der Merwe, intended, possibly instructing senior, advocates Christo van Schalkwyk and Gideon Scheltema for the 18-day trial set down for August.

18 day trial, faq this guy was unloading the cash and has quite a war chest for lawyers, attorney and 2 x senior advocates x 18 days.

Technically he could use some of the stolen money to defend himself in court, because they haven't proved he stole it yet?

Former Durban principal in the dock on 1 600 charges of theft and fraud

Durban - Former Glenwood High School headmaster Trevor Kershaw would be facing an "unfair trial" if he were forced to defend himself now against the approximate 1 600 charges of theft and fraud listed on the charge sheet.

This was the submission on Wednesday of his advocate, Gideon Scheltema, SC who argued on what was to be first day of Kershaw's trial in the Durban Commercial Crime Court, that the forensic auditor hired by the school to probe his client’s alleged crimes was not impartial and was intent on a character assassination.

He also accused the State of "swamping" the defence with "thousands and thousands" of documents in electronic form "some of it useless", withdrawing charges on the eve of the trial, "slipping in evidence through the backdoor" and "throwing the book" at his client.

Kershaw, 56, taught at the school for a number of years, was appointed principal in 2000 and retired early in December 2015.

He was arrested in April last year and, at that stage, was facing one count of fraud/alternatively theft, for allegedly misappropriating about R5m from school and boarding school funds.

A subsequent charge sheet, apparently drafted on completion of a forensic audit conducted by Integrated Forensic Services, lists 1 624 charges involving alleged reimbursements he made to himself in cash or through electronic transfers using "home made" invoices.

One of the counts involves the purchase of a Jeep Patriot for R370 000.

Scheltema, in his argument before Magistrate P Naidoo, objected to the presence of forensic auditor Eckhard Volker, who appeared ready to begin his evidence, with computers set up and four large "bins" containing dozens of files at the ready.

'Material witness'

The advocate said the charges were largely based on Volker's report.

"He is a material witness but our information is that he acted as an agent for the governing body of the school. He stands in the shoes of the complainant….he laid the criminal charges.

"The legality of this and his report will be in serious dispute at any eventual trial.

"He also gives character evidence in his report. He makes statements that my client had an aggressive management style, bordering on autocratic and being a bully….this is not the role of an accountant.

"He is not an independent, impartial witness, he is an adversary," Scheltema said.

He said it had become an impossible task to go through the "epic" forensic report - with its graphs, spreadsheets, documents, files and subfiles "because we don’t know where to look and for what".

He said requests for further particulars were met with "look at the report", but even Volker had conceded the report was complex and could not just be printed out and read.

"We are not accountants. If a team of experts find this difficult, where does this leave the accused?"

He said very recently, Volker had actually conceded that 28 counts should not be prosecuted after re-examining the documents.

"We just don't know what other mistakes could have occurred," he said.

He accused the State of taking a simple matter - with one main charge - and turning it into an "impressive big case".

'Slipping into evidence'

In another response to a request for further particulars, the defence had been told to look at negative comments about the issue of Facebook.

"This is first for me," the experienced advocate said.

"There is also reference to newspaper articles which reflect 'outrage'. It is stated that apart from the financial loss, everyone in the school community suffered emotional duress.

"There is opinion - and yet no affidavits we have seen - which talks of talented boys opting not to go to the school, [because] of sponsorships for events being cancelled.

"All of this is slipping into evidence….someone is trying to sensationalise the matter.

"From day one there has been a campaign to paint my client in a bad light."

Scheltema asked for more time to present case law to the magistrate and Prosecutor Wendy O’Brien will then be given an opportunity to respond.

The magistrate will then have to make a ruling on the way forward.

According to documents attached to the charge sheet, the Asset Forfeiture Unit "froze" Kershaw's assets last year. This included his house in Westville and the Jeep.

Slow progress in case against former headmaster

The State has accused former Glenwood headmaster Trevor Kershaw's legal team of "delaying" the start of his fraud trial.

Public prosecutor Wendy O’Brien said on Wednesday that she did not know if they intended to proceed with a trial at all.

Kershaw is facing more than 1 600 counts of fraud, in connection with work-related claims he made from Glenwood during his time there.

He was arrested and charged last year.

His trial was supposed to begin last week but it has been placed on hold.

Just before the State could call its first witness, forensic accountant Eckhard Volker, Kershaw’s advocate, Gideon Scheltema SC, announced they were objecting to the charges.

Scheltema says the State has given him and his instructing attorney, Carl Van Der Merwe, 17 lever arch files. The details of the offenses Kershaw is accused of, are contained therein.

But, Scheltema says, these are so voluminous and complex that it is virtually impossible to make sense of them.

This is an open and shut case.

“Investigations were launched following concerns about the legitimacy of claims Kershaw had made to the school, which were paid out to him, either in cash or as electronic funds transfers (EFTs), as part of his remuneration package, or as reimbursal for school expenditure he incurred from his own funds, allegedly on behalf of the school,” the charge sheet reads.

These investigations apparently revealed that Kershaw submitted 1 623 transactions for refunds totalling more than R5.2m. Among these transactions, Kershaw allegedly claimed R971 500 payable to himself and another related party through 107 “home-made” invoices.

“The claims Kershaw made are based on inappropriate supporting documentation, representing either credit card Speedpoint slips or credit card bank statements, unsupported claims, duplicated claims and manipulated vouchers.”
