Principal's trial set to stretch out

The trial of the fraud-accused former headmaster of Glenwood High School, Trevor Kershaw, will not be getting under way any time soon.

His legal team is turning to the high court, after the regional court threw out their request for more detailed information pertaining to the charges they are defending their client against.

Magistrate Judy Naidoo dismissed their application in Durban’s Special Commercial Crime Court on Wednesday, after which Kershaw’s advocate – Gideon Scheltema – said they would be taking her decision on review.

That process – which requires first that the tape recordings of proceedings thus far be transcribed – is expected to span several months.

Kershaw’s trial was scheduled to begin this month.

But on what was to be the first day, his legal team announced it was objecting to the charges.

According to the Criminal Procedure Act, a person accused of a crime can object to the charges against him or her at any time before entering a plea of guilty or not guilty.

If his or her objection succeeds, the court can order the prosecution to amend the charges or to furnish the defence with additional 
information.

Former top Durban school principal in plea negotiation over 'stolen' money


Former Glenwood High School headmaster Trevor Kershaw, charged with defrauding the school of more than R5m, is in plea negotiations with the state.
Kershaw, who was arrested in 2016, was to stand trial before Durban commercial crime court magistrate Dawn Soomaroo on Thursday.
But defence advocate Gideon Scheltema SC and state prosecutor Wendy O’Brien asked that the matter be adjourned to allow negotiations to continue.
Kershaw, 58, was the principal of the school from 2000 until December 2015.
It was during his tenure, the state alleges, that he paid himself from school coffers in cash or through electronic transfers using “home-made” invoices.
O’Brien told the court there was “determination from both sides” to resolve the issue without going to trial.

No jail time for Durban school head who pleads guilty to R5m fraud

Disgraced Glenwood Boys' High School headmaster Trevor Kershaw has pleaded guilty to defrauding the school out of more than R5.2m through duplicated claims, “home-made invoices” and manipulated vouchers. Kershaw, now 58, was headmaster at the school from 1999 until 2016 when he resigned under a cloud. He now works as a storeman at a firm owned by his brother. While he will serve no time in jail, R3m, being the cash value of assets which were seized by the Asset Forfeiture Unit, will be released to the school.

Kershaw also has a 10-year suspended sentence hanging over his head and, under correctional supervision legislation, he will be under house arrest for three years and required to do community service and attend rehabilitation programmes. The school is still suing him personally - and the auditors who signed off on the school’s financials between 2007 and 2016 - for damages relating to the 1,623 dodgy reimbursement claims he made and what it cost the school to pay for a forensic audit to determine the extent of his fraud. In a plea bargain which was negotiated between his lawyers, Carl van der Merwe and advocate Gideon Scheltema SC, with prosecutor Wendy O’Brien, Kershaw says he is “remorseful”. He says “due to an excessive workload” he did not keep the necessary documents to substantiate his reimbursement claims for “actual expenses” incurred on behalf of the school.

“Over time, he submitted claims on documents which had either been lost or replaced. Many were based on fictitious documents, not reflecting the disbursements accurately. “He foresaw the possibility that the school was being misled but nevertheless continued ... with actual prejudice to the school.” The agreement, which was signed off by specialist Durban commercial court magistrate Dawn Soomaroo on Thursday, stated that the most significant general ledger allocation was labelled under the reference “packer” - which totalled an unjustified claim for about R2.5m for additional remuneration.

Durban - The former head of Durban’s Glenwood High School, Trevor Kershaw, will spend the next three years under correctional supervision with a 10-year suspended prison sentence hanging over his head.
This after he pleaded guilty to fraud charges of just over R5million. A plea agreement with the State was reached on Thursday.


The case has dragged on in the courts for the past three years after Kershaw was charged with defrauding the school in 2016.

So he was guilty after all, did he have a secret coke and hookers habit, or else why do something as stupid as cooking up homemade invoices to make false expense claims?

Probably also the reason he settled before it went to trial, could see his habits would come into the public domain and what little was left of his reputation would be reduced to incy wincy pieces.
