He wasn't speculating. He was wording his statement so that he doesn't get sued by TMZ.
There is one way to get a story out that quickly with the copyright owned by TMZ. The owner of the original video has to give it to TMZ and give them copyright.
He explained it rather well... if you watched the trial.

The witness made it clear that the only way TMZ could get the copyright to a video is if they bought it off someone. The video was made by Amber Heard, so she was the copyright holder before TMZ became the copyright holder.

How did the copyright transfer happen?

And in her deposition, what did she mean when she said she wanted Depp to "find out from someone other than TMZ, who were alerted"?
