Mate, a crime was committed. He ran over children with his car. Whether you feel that way is immaterial. The courts will establish facts and rule accordingly. If it was a genuine mistake, then he'll be tried for something less severe.

The law in SA is applied differently depending on the race of the complainant and perpetrator. Like the Coligny two...

Why do you feel that way? Give examples where a black murderer was acquitted despite glaring evidence against them.

Incorrect, hitting someone with a car doesn't automatically constitute a crime.

It depends on the motive, condition of driver as well as that of the car.


Information available to the police at the time was that a bunch of children stole mielies, he gave chase with his car and intentionally ran them over. This is a crime. However, he has stated in court that he lost control of the car. The courts will decide whether his version of events is truthful, and act accordingly.

Btw, the fact that he summoned the police and paramedics immediately will help support his case.

I suppose the concept of double jeopardy to you is watching two episodes of Jeopardy! back to back....

Unfortunately for you, what you want is plainly illegal in South Africa.

Every accused person has a right to a fair trial, which includes the right ...not to be tried for an offence in respect of an act or omission for which that person has previously been either acquitted or convicted;

If the state wants murder and assault charges, then that is what he will go to court for. If he is found innocent of those charges, the state cannot say: well he is innocent of murder, but we will now bring a charge of culpable homicide against him instead. The state has one trial to find him guilty of murder and assault. If they don't succeed with that, it is over.

He was arrested because what the police established when they arrived at the scene was that he intentionally ran over the kids after they stole from him. He would not have been arrested had this been an ordinary road accident.

He was in court to apply for bail. He's not on trial yet. His charges may be adjusted once facts are established.

I've never done it so can't answer that.


However, he may have been overcome by anger but realised his mistake after the deed. I don't know. Maybe it was a genuine accident. Facts will come out soon. I'm pretty certain he has many character witnesses.
