Sounds like it could be entrapment to me, given that an agent from homeland security actually paid her via PayPal to get the pictures.
I don't think this is how entrapment works. she wasn't tricked into it.

If they suspected her from being involved with this, they can approach a court and obtain an order which will allow them to entrap her.
If they made an initial offer to her for pictures or put the idea forward then that's a very different scenario to them finding her advertising the pictures. I don't know what went down but once they paid for said pictures it enters murky legal waters, imo. Either way, the actual victim is the child, who knows what will happen to her now...

By the way, section 252 of the Criminal Procedure Act has not yet been declared unconstitutional, not in SA nor elsewhere. But, it has become common practice by police authorities to approach a magistrate or judge before hand and then get a court order to do the entrapment. In the old days prior to 1994, police quickly received permission from the old Attorney General offices.

252A. Authority to make use of traps and undercover operations and admissibility of evidence so obtained

(1) Any law enforcement officer, official of the State or any other person authorised thereto for such purpose (hereinafter referred to in this section as an official or his or her agent) may make use of a trap or engage in an undercover operation in order to detect, investigate or uncover the commission of an offence, or to prevent the commission of any offence, and the evidence so obtained shall be admissible if that conduct does not go beyond providing an opportunity to commit an offence: Provided that where the conduct goes beyond providing an opportunity to commit an offence a court may admit evidence so obtained subject to subsection (3).

Entrapment is allowed in almost all countries. It is a necessary tool in law enforcement, at least in countries serious about it.

And lastly, yes, you can get a court order, which clearly identifies the individual being entrapped, the crime, how entrapment will happen and the full details of every person involved in the entrapment (since every person, law enforcement or not, who will participate in the entrapment will be involved in a criminal offence and the court order also protects all names in the order from any possible prosecution, as long as the court order is adhered to). In order for the evidence to be allowed in court, this order needs to be adhered to, to the T.

Entrapment is when you directly influence someone to commit a crime that they otherwise would likely not have done. If the mother was offering pictures of her child and an official pretended to be a buyer in order to set a trap - that is not entrapment. If the mother had made no indication she intended to sell photos of her child and an official convinced her it was a good idea, in order to set a trap, that would be entrapment and is not legal in most of the Western world.

There is nothing in the article to suggest that the FBI did any of that. It would be kind of retarded if the FBI went into Sunday School parental groups and lured mothers onto the dark net with the intention to get mothers to pornify their children. Wtf are you on about?

True as that is.... I can see it happening. The FBI has always been a goals oriented organization that made things happen with dirty tricks.
