Feedback on the ASA Complaint Against Sentech?

Hi,

ASA is contacting me on Monday with feedback and Ill post all feedback here.

Just replace fiat with sentech and fuel consumption with download speed in the following article. Maybe someone should contact Ina Opperman ;)

By all means, write to Ina with your complaint. She then forwards it to the company in question, asks for their reply (which can take a month or more), edits both and publishes it. It helps.

Hi All,

I just received feedback from ASA. Sentech has submitted their response, and it is going to the legal board of ASA to be discussed and a ruling will be made within a week. Cannot find out now what Sentech wrote in their response but I do know from what was briefly said they gave definitions of Broadband and 128k etc, wonder what lies they wrote in there - but after the ruling the sentech feedback will be made public and we can see whether the response is acceptable or not...

Would love to see them explaining :
"Broadband refers to a connection speed from 128Kbps and higher from the end user to the network provider"

Sounds odd that they can attend and not you?????

The "hearing" is basically just ASA staff and their legal board. Sentech and myself are not attending and we'll be told what the ruling is within a week ...
Now they are evaluating all sentech's ads - my complaint, and sentech's comments. Wonder what their story is not that they themselves admit there is a speed problem I mean that is admitting the ads are false.

Hi All,

I have spoken to the representative at ASA dealing with the case, they have not yet reached a decision. They will let me know once they have. They are a few days overdue now so hopefully it is good news for us, the poor users who were tricked by their advertising that this is a high speed service.

This is VERY good news. ST can fob us off when we ask for official clarrification of issues but they cannot fob off the ASA.

The ST feedback will make interesting reading. Should there be major flaws in their arguments we can submit a new complaint and start the whole process all over again.

If this one fails for any reason the next ASA submission should be a communal effort in my opinion we need to get together a comphehensive bullet proof complaint.

There must be other bodies that we can contact too? Is Sentech listed? They are a member of the ISPA and have hence bound themselves to their code of conduct which they are obviously breaking. Surely some of the forumites have had dealings with the ISPA? Point us in the right direction please ...

I wrote to the ASA pointing out Sentech's <b>own</b> definition of broadband in their press release.

Today I received a fax asking if I wanted to make a formal complaint, which can be added to the existing file. I was also told that I would be advised when the formal hearing was going to take place.

I phoned Puseletso Matene at the ASA and she said that a <b>date for the hearing has not been set</b> yet.

If anyone else wants to file a complaint, this is what you do: Send an email to complaint@asasa.org.za (not complaints@ as on their web site). State that you wish to file a complaint, and state your complaint. BUT, and this is a BIG BUT, <b>do not</b> complain if your complaint is just repeating what has already been said. We don't want to delay things any further. I wrote just to add things to the existing complaint. Has the text of the original complaint been posted somewhere? I can't find it.

This is indeed good news. It means Sentech has been unable to convince them they are not lying. The company I work for is part of ISPA - So I will forward the email to a representative there and enlighten them.
