This week marked four years since a court ordered Brian Molefe to repay millions he unlawfully received from the Eskom Pension and Provident Fund.

On 25 January 2018, Judge Elias Matojane delivered a brief but scathing judgment in the North Gauteng High Court against former Eskom CEO Brian Molefe. Two years earlier, Molefe had resigned from Eskom after former Public Protector Thuli Madonsela exposed his close ties to the Gupta family in her State of Capture report.

Molefe was granted early retirement and Eskom had committed to paying the early retirement penalties and purchasing the additional years of service on Molefe’s five-year contract, which came to R30.1-million after only 16 months of service.


Molefe claimed that Eskom had mistakenly approved his early retirement in 2016 when he wasn’t eligible (he was 50 and early retirement can only be approved at 55) and that he should be allowed to return to work at Eskom.

The court, however, declared that Molefe’s reinstatement at Eskom was invalid and said the early retirement package was “patently unlawful”. It ordered Molefe to repay the Eskom Pension and Provident Fund (EPPF) the money he’d already received, which at the time was reported to be an estimated R11-million.

Molefe appealed in the Supreme Court of Appeal and Constitutional Court. Both applications were dismissed. But four years since Matojane’s judgment, Molefe still hasn’t repaid the EPPF a cent.

The matter is still before the courts, it says so right there in the article.
The same courts that can't get Zuma in for an official legal opinion of the evidence around the Thales weapons deal for around 20 years? The same case due to which Thales has actually had to pay fines abroad to other countries, hundreds of millions of Dollars. While we who are the victims only get to pay Zuma taxes for decades, because he had to steal a country and dismantle vast parts of what made it function as part of his effort to stay out of court?

I think everything is captured. It's just that some days they do something that is very uncaptcharistic so is to make people wonder: "Hey maybe this is not as captured as we've been told!" and then when they have the nation believing this is the case, they resort to captured again. It's all part of the plan. Makes you doubt your own version of reality and question your own judgement. The soviets taught these mother****ers all the tricks in how to turn up the heat on the simmering frogs.

Honestly its time for the courts to grow some teeth, the people surrounding the state capture (Guptas friends) need to be brought in, in this case its clear that he is in contempt, and can be no should be thrown in jail.

The only way to get to Zuma is to apply pressure to all of those involved, and I do mean all of them, throw them in jail where legally applicable (throw the book at them) and watch Zuma skirm.

I would hope he sold his country and soul for a lot more, so he must have some stashed away just maybe not readily and safely available.

You sound so sure? As soon as the court determines the amount the pension fund is not going to ask nicely, if there is so much covering for one another what happened to all the others who had part or all of their pension seized?

Why was there no cover up for Bathabile? Because she is a woman?

That's correct....but unfortunately not so emotional as the article's click-bait headline.

He will pay...

This matter is set to be heard at the North Gauteng High Court on 16-17 March 2022. Once the court has determined the amount due, we will expeditiously take all necessary steps to get those monies paid,” the EPPF told Daily Maverick.

He's just desperately delaying the inevitable.
