GRIEKWASTAD CASE COULD BE RE-OPENED

The 17-year-old accused in a Griekwastad farm murder wants his trial in the Northern Cape High Court re-opened.

Riaan Bode, for the boy, told Northern Cape Judge President Frans Kgomo on Tuesday the application did not rest on a contention that the previous legal team was incompetent.

The matter was postponed in December last year after the boy ended the mandate of his previous lawyers, Willem Coetzee and Sharon Erasmus, who had withdrawn from the case.

They had been instructed by attorney Stoffel de Jager.

Earlier, the boy's guardian indicated there were insurmountable differences between him and the legal team.

The application for a postponement was filed by Bode, the youth's new lawyer.

On Tuesday, Bode submitted the core of the State's case was the rape charge which was seen as the trigger for the murders.

Bode submitted that the defence would like to call an expert witness to give testimony in relation to the rape charge.

Prosecutor Hannes Cloete indicated that they would oppose the application.

The 17-year-old youth is accused of shooting dead farmer Deon Steenkamp, 44, his wife Christel, 43, and their daughter Marthella, 14, on April 6 2012. He faces an additional charge of raping Marthella and of lying to the police.

He has denied the charges, and has told the court someone else must have been in the Steenkamp house on the day of the murders.

However, the State has claimed his evidence was in the realm of the impossible.

Application dismissed.

Case will not be reopened. Only the verdict and possible sentencing remains now.

EDIT: Sorry. New lawyer will be allowed to give closing arguments. Then verdict.

GRIEKWASTAD BOY'S NEW EXPERT WITNESS UNRELIABLE

The report of a new expert witness in the Griekwastad murders trial is unreliable, the Northern Cape High Court heard on Tuesday.

Northern Cape Judge President Frans Kgomo was hearing argument in an application by the 17-year-old boy to reopen his case.

Prosecutor Hannes Cloete submitted that the testimony of the State's two expert witnesses in relation to sexual injuries on one of the victims could not be discredited by the defence's new expert.

"The springboard of the new expert's testimony falls away," said Cloete.

The youth is accused of shooting dead farmer Deon Steenkamp, 44, his wife Christel, 43, and their daughter Marthella, 14, on April 6, 2012.

He faces additional charges of raping Marthella and of lying to the police.

He has denied the charges and told the court someone else must have been in the Steenkamp house on the day of the murders.

However, the State has claimed his evidence was in the realm of the impossible.

The youth's new lawyer Riaan Bode submitted the application was to present new evidence for consideration on the rape charge.

The defence submitted the application did not rest on a contention that the previous legal team was incompetent.

Cloete submitted the defence had failed to show that the new evidence would have a substantial impact of the case.

The defence's new expert had formed his opinions from photo's, something a State witness had already warned about.

He contended that the report of the defence's new expert was opposed by evidence already before court.

Judge Kgomo adjourned the court for a decision until 2.30pm.

JUDGE REFUSES RE-OPENING OF GRIEKWASTAD BOY'S CASE

Northern Cape Judge President Frans Kgomo on Tuesday dismissed an application by the minor accused in the Griekwastad farm murders trial to reopen his case.

The 17-year-old boy's new lawyer Riaan Bode filed an application for the case to be reopened to, among others, submit further expert evidence.

The State opposed the application.

Kgomo said he was satisfied that the youth did not make out a proper case for reopening his case. Therefore, the application was refused.

He would give reasons for the decision later. Kgomo postponed the case to Tuesday March 25.

GRIEKWASTAD RAPE CHARGE HAS NO RELEVANCE

The rape charge against the 17-year-old youth accused of the triple Griekwastad farm murders has no relevance to the murders, the Northern Cape High Court heard on Tuesday.

Northern Cape Judge President Frans Kgomo was hearing final arguments in the boy's murder and rape trial.

He is accused of shooting dead farmer Deon Steenkamp, 44, his wife Christel, 43, and their daughter Marthella, 14, on April 6, 2012.

He faces an additional charge of raping Marthella and of lying to the police.

Riaan Bode, for the youth, submitted the evidence indicated that the alleged sexual injuries were caused 12 to 72 hours before death.

Bode urged the court to take notice of this time factor and the possibility that a rape could not have taken place during the attack.

The time factor did not fit, he argued.

Bode further questioned the State's charge of rape on the grounds that there were not enough facts to substantiate the allegation.

The State should give an indication of how the alleged rape took place.

Bode also submitted the State's expert witnesses on the rape charge indicated that the "redness" to the girls genitals could have been caused by something else.

Replying to a question by Kgomo, Bode submitted he could only speculate on the severe injuries to the girl.

He also submitted that the slightly built boy could not have attacked Deon Steenkamp, who was described as a big man.

There was also no DNA of the farmer found on the boy, which seemed highly unlikely due to the injuries allegedly inflicted by the boy.

"It's unlikely."

Bode argued the police investigation into the murders also left question marks.

He submitted that the fact that no usable fingerprints were found on the scene meant it was not properly investigated.

Bode also included in this argument the handling of DNA evidence.

Foreign DNA was found on the murder weapons but this was not investigated further.

Bode submitted the burned and destroyed green Jeep jacket found with Deon Steenkamp could have contained DNA of the attacker during the struggle with Deon.

Bode submitted the handling of these aspects and the fact that the State's case was based on circumstantial evidence meant the boy was robbed of possible facts in his favour.

"The fact is, on the State's case, there are other possibilities," said Bode.

He further argued that it was not unlikely that somebody else was at the murder scene other than the boy.

The State is to present final arguments after the lunch break.

The case continues.

JUDGEMENT FOR NCAPE BOY

The Northern Cape High Court is expected to pass judgement on Thursday with a 17-year-old boy accused of killing the Steenkamp family on their farm.

The youth is accused of shooting dead farmer Deon Steenkamp, 44, his wife Christel, 43, and their daughter Marthella, 14, on April 6 2012 on their farm Naauwoek, near Griekwastad.

Prosecutor Hannes Cloete told the court on Tuesday that the boy attacked the Steenkamp family and nobody else.

He said the defence's submission of a possibility that there could have been another person on the murder scene was wrong.

Cloete argued there were no grounds for the criticism of the police investigation into the Steenkamp murders.

He told the court as prosecutor he could find no faults.

"The scene was recorded like few others."

He is going down today. Judge clearly had his mind made up even before the new lawyer did his closing arguments.

Be interesting to see what sentence he gets.

JUDGMENT STARTS IN FARM MURDER CASE

Northern Cape Judge President Frans Kgomo began delivering his judgment on Thursday morning in the triple murder trial of a 17-year-old youth.

Kgomo started by indicating that the court sat as a children's court. He said everything was done to give the boy a fair trial.

The boy was represented by experienced counsel and had pleaded not-guilty but did not disclose his defence.

It was common cause that the boy was at the farm when the crimes were committed.

Kgomo said the quiet town of Griekwastad was rocked on April 6, 2012, when the boy arrived at the police station to report the murders.

He stands accused of the murders of Northern Cape farmer Deon Steenkamp, 44, his wife Christelle, 43, and daughter Marthella, 14.

They were shot dead on their farm Naauwhoek, near Griekwastad, on April 6.

The teenager also faces a charge of raping Marthella and defeating the ends of justice.

Judgment continues.

Reading the details of the 3 victims' injuries and especially that of Marthella is horrific. What was going on in this child's mind????
