I was once almost fired.

But before my manager could say the phrase I whipped out a letter of resignation which I've been carrying with me for the last 2 weeks.

It was a **** job anyway.

Door-to-door cold calling for ADT home alarm systems.

Good one!

Almost similar thing happened to me. It was a family business and the CEO was as dodgy as they come. During my December holiday break, I thought about it and already made up my mind to resign. It was a bold step at the time because I had a family to support. It turned out to be one of the best decisions I have ever made. Six months after I left, the CEO fled the country and that company simply collapsed. Most of their clients were Government employees. Shocker! :erm:

Was to young and stupid to take the idiots to the CCMA.

Yes it was a bad time in my life and I was very skinny and did not sleep well. Was living on coffee. :( was worse after that. I had no job and was homeless. Thanks to a good friend or two I had a couch to crash on.

Currently "retrenched" :)

Company filed for liquidation a few months back..so I'm a "man of leisure" at the moment.

Downside with liquidation is that we received no paycheck in the month of liquidation, no notice pay, no severance package, and I lost about R120k+ in leave pay due to me..
All the severance/notice/leave etc will go into a liquidation claim but not hoping for/expecting much out of it.

Interesting time and experience, definitely forced me out of a comfort zone of salaried employment in somewhat dead-end space. Given the last year of stress, I'm loving the "freedom" from corporate and I haven't been happier (despite the lack of an income which is starting to become a concern).

Dig the forced crossroads though and leaning toward efforts on my own business instead of corporate, money runs out soon so have limited time to "make it happen"!

My first company fired me for a good reason. The client I was working at approached them without my knowledge and said something to the affect of, "We are taking him, what do we have to pay to make it happen". So my boss told me that he was not renewing my next 6 month contract but for a good reason and handed me the offer from the client. Was weird. I was angry at the time as it felt like they sprung it on me but in the end it was the best thing that could have happened. Before I was a contractor, and the client made me permanent. This all in 2007 right before the 2008 crash. When that happened the client got rid of all the contractors and just stuck with us permanent staff. Hence it was a good thing despite it technically being my termination.

I got fired at my last company, basically they started short paying my salary and started paying it late. Would get to a point where on the 1st my debit orders run and I hadn't been paid so they were bouncing. Happened 3 months in a row, they paid me like half way in the month and only half my salary, was battling to pay rent and food, was living off toast and butter at nights so went into a state of depression not knowing how I was going to get through this cos I was owed a few months worth of salary and whenever I went to discuss it with the bosses they would just say that I will get paid and that was the end of the discussion. Eventually was so depressed I stopped working all together and started stuffing up at clients when I did go out that they fired me, although i should have resigned several months before that point.

When I was younger, I was "Let go" as the boss could not afford me anymore - was a video store that was not doing well.
Other than that, I have never been fired or retrenched. *Touches wood*

I feel sorry for people who get retrenched - not fired though.

One of my clients recently let go 10 staff members. While another 10 resigned. They were taken over by a bigger company and it got messy. Our services were also "Let go".

Life moves on. :)

What is the law regarding leave accrued/paid out?

At worst case, is there a minimum that should be paid out?

In all cases (retrench or fire)?

I heard something about you can only accrue a certain amount of leave before it falls away - so maybe a years worth or so? I've got 2.5 years accrued and was wondering if I got retrenched/fired/resigned

I believe if you're fired - you get your last paycheck and that's it.

On termination of employment, an employer must pay an employee--
a)for any paid time off that the employee is entitled to in terms of section 10(3) or 16(3) that the employee has not taken;
b)remuneration calculated in accordance with section 21(1) for any period of annual leave due in terms of section 20(2) that the employee has not taken; and
c)if the employee has been in employment longer than four months, in respect of the employee's annual leave entitlement during an incomplete annual leave cycle as defined in section 20(1)--
i)one day's remuneration in respect of every 17 days on which the employee worked or was entitled to be paid; or
ii)remuneration calculated on any basis that is at least as favourable to the employee as that calculated in terms of subparagraph (i).


HOWEVER:

Unless an agreement provides otherwise, this Chapter does not apply to leave granted to an employee in excess of the employee's entitlement under this Chapter.

So if you get more than 15 days a year, and your contract does NOT state anything about leave accruals, payouts etc, then you might not get leave in excess of the minimum paid out.

No. I have been threatened with a warning once when a co worker lied and made it out that I was incompetent, she eventually was caught out and let go after she tried the same thing with one of the directors.
