Home owner want to move in but I still have 1 year and 4 month on my contract.

I know a lawyer , she'll review the contract, I also contacted the agent and she will get back to me as well as I will check out Rental Tribunal.
The contract almost everywhere says 2 years however I see his point with the "12 month initial" portion of the contract.
Of course everyone agrees including him that he can not make me move by the end of the month as he first asked me to.

That was a cnt move of him to try so don't go easy on him if it puts you in a pickle, use what you are legally entitled to, which is to see out the lease till end of December or whenever the first 12 months end. If you are entitled to the full 24 months lease use that as leverage if needed, play hard ball with hard ball.
 
If I were you I would get him to agree to foot your relocation costs or let you see the lease up to December, Everything else is just a waste of money and energy. Even if he agrees to let your lease run to the end of 2025, your relationship has soured and things will only get worse.Find another place and don't get attached to things that don't belong to you, it will save you from making emotional decisions.
 
I feel like he is trying his luck, first was move by end of this month , if can't end of next month, now is move end of next month+ i'll pay up a penalty of 1 month rent to you, else you can move end of December.
I am keeping quite all I said if i am checking the contract and as far as i am concerned I signed a 2 years contracts.
 
So the agent finally called us today, and she is taking the landlord's side.
I tried to ask said that everywhere in the contract it says 2 years. except for the initial term,
plus we verbally asked for a 2 years contract (no proof on a verbal conversation but just the fact the the contract says 2 years).
The agent of course immediately said "I will find you a new place", yes more money to her, of course she'll take his side.

So how does the house of Rental Housing Tribunal works, I will send them an email with all the details?
We are also going to look for another place, maybe something nice will come up.....he offered 1 month rent to be paid to us to leave end of October (in his mind 2 month before we have to move).

What does your lawyer friend say after looking at the lease?
Can you post the pertinent parts of the lease here with all the identifying info redacted?

Will he pay you one months worth of rent to move or just refund your deposit?
 
She is on leave at the moment, but in her mind a mistake was made in the contract, and it'll be a tricky situation.

1 month on top of my deposit to leave 2 month early (according to him) or 1 year and 2 month according to me. either way I don't think it's a fair offer. not sure if the forum agrees.

So was that supposed to be 31 December 2024 but they made a mistake?

Well the clause regarding the initial period does effectively reduce the lease to 12 months because the owner has exercised his option to terminate the 2yr lease before the initial period has passed. That's not an unusual clause and you could have exercised it yourself if you didn't want the full 2yrs lease.

Have a look what's on the market and if there's something suitable I’d take the guys one month rent payout and go, it'll probably cover a removals company to both pack and move your stuff so far less hassle for you. At the new place make sure your lease is for the full 2yrs with no exit clauses for the owner.
 
NB: Not legal advice. The fact that there is an initial term requires positive action at the end of the term i.e. willingness from the tenant and the landlord to continue past the initial term.

I am going to side with the landlord that you should be out by 31 December 2024.
 
It seems that the contract was only edited with the initial 12mths and not on every place it referred to periods.
But signed so IMO both are wrong.
So intention was initial 12mths and I would say get out latest the or preferably sooner.

Agent are scum. Ignore them. Stick to the dates in the contract. Don't communicate anything by email or text that you will be out by end October.

You send an email to the Rental Housing Tribunal or phone them. Then the timer starts which buys you at least 3 months or however long it takes them to respond and process. They will contact the owner/agent to get their side of the story. They will then contact you to organise a meeting. If the meeting is not near you, you can ask for a virtual or telephonic meeting. The owner or agent will most likely lie, so you provide them with proof of the contract. They will tell the owner / agent to back off, contract will be honoured. If it goes further than this, they will set up a special internal hearing, if it goes further than this, it will go to a magistrate, if it goes further than this, it will go to a higher court. By now we are in 2030 and you still have a lovely place you stay in.

Contact the Rent Housing Tribunal ASAP. I am disappointed that you have not done it yet.

In the meantime you still have a place till end of the year and continue to pay your rent.
